ORDINANCE NO. 1496-15

 

AN ORDINANCE DESIGNATING CERTAIN STREETS WITHIN THE CORPORATION LIMITS OF THE VILLAGE OF PAULDING, OHIO AS “NO THROUGH TRUCK ROUTES” DURING CONSTRUCTION OF PHASE II OF THE VILLAGE’S SEWER SEPARATION PROJECT ON NORTH WILLIAMS STREET (U.S. ROUTE 127) AND DECLARING AN EMERGENCY

 

WHEREAS, the Village of Paulding, Ohio, on or about April 1, 2015, will begin construction of Phase II of the Village’s sewer separation project on North Williams Street (U.S. Route 127); and

 

WHEREAS, the Village Council has determined that it is necessary to restrict “through truck traffic” on certain Village streets during said construction in order to protect the public safety, health and welfare and in order to protect the integrity and usefulness of said streets; and

 

WHEREAS, the Village has consulted with the Ohio Department of Transportation (ODOT), and it has determined that through truck traffic shall be prohibited on certain Village streets while Phase II of the Village’s sewer separation work is being done on North Williams Street (U.S. Route 127);

 

NOW, THEREFORE, be it ordained by the council of the Village of Paulding, Ohio:

 

Section 1. No trucks shall be operated over and along the “No Through Truck Routes” established pursuant to this Ordinance unless otherwise provided herein.

 

The following routes shall be designated as “No Through Truck Routes”: all streets within the corporation limits of the Village of Paulding within the area bounded by Gasser Road (at the west corporation limit)/Dooley Drive on the north, Emerald Road from Dooley Drive south to East Jackson Street on the east, East Jackson Street from Emerald Road west to South Water Street, South Water Street south the East Perry Street, East Perry Street west to South Main Street, South Main Street south to East Wayne Street, East Wayne Street west to County Road 103, County Road 103 north to County Road 142, east and then south on County Road 142 to West Caroline Street, east on West Caroline Street to North Dix Street, north on North Dix Street to West Garfield Avenue, east on West Garfield Avenue to the intersection of West Garfield Avenue and North Walnut Street, west on Garfield Avenue Extended to Kay Nora Street and north on Kay Nora Street to Gasser Road. Section 2: Signs shall be clearly posted at the entrance points to the above described Village streets indicating that such traffic is prohibited.

 

Section 3: The provisions of section 1 do not apply to vehicles owned or operated by the Village, pick-up trucks or vans.

 

 

 

Section 4. This Ordinance shall not prohibit:

 

     A.  The operation of regulated vehicles that are making pickups, deliveries or which have

           other specific business such as being enroute to repairs provided that the driver can

           show proof of said business through documents such as bills of lading;

 

     B.  Authorized emergency vehicles or other vehicles operated by units of local government;

           or

 

     C.  Detoured trucks, on an officially established detour, if such trucks could lawfully be

           operated upon the street for which the detour is established.

 

Section 5. A violator this ordinance shall be deemed guilty of a minor misdemeanor and shall be fined not more than $150.00 for the first such offense; whoever is convicted of or is found guilty of a second offense within one (1) year after the first offense shall be guilty of a misdemeanor of the fourth degree and shall be imprisoned or jailed for not more than thirty (30) days and fined not more than $250.00; whoever is convicted of or is found guilty of each subsequent offense after the first and second offense within one (1) year shall be guilty of a misdemeanor of the third degree and shall be imprisoned or jailed not more than sixty (60) days and shall be fined not more than $500.00.

 

Section 6. This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public safety, health, peace and welfare; wherefore, this Ordinance shall be in full force and effect from and immediately after its passage.
