Ordinance No. 1410-10

 

 

AN ORDINANCE DESIGNATING

LELA McGUIRE JEFFERY PARK

A SMOKE-FREE, ALCOHOL-FREE

AND PET-FREE FACILITY.

 

WHEREAS, on December 31, 2008, the Village of Paulding, Ohio, obtained 29.856 acres of real estate from Terry D. and E. Marlene Buehler for the creation of Lela McGuire Jeffery Park; and

 

WHEREAS, The Village Council of the Village of Paulding, Ohio, finds that Lela McGuire Jeffery Park should be designated a smoke-free, alcohol-free and pet-free facility for the protection of the public health, safety and welfare.

 

NOW, THEREFORE, be it ordained by the council of the Village of Paulding, Ohio:

 

Section 1.        Lela McGuire Jeffery Park shall be and hereby is designated a smoke-free, alcohol-free and pet-free facility for the protection of the public health, safety and welfare.

 

Section 2.

 

   A. Smoking shall not be permitted in Lela McGuire Jeffery

        Park.

 

   B. Smoke or smoking means the carrying or holding of a lighted

        pipe, cigar or cigarette of any kind, or any other

        lighted smoking material, equipment or device, and the

        lighting, emitting or exhaling the smoke of a pipe,

        cigar, or cigarette of any kind.

 

Section 3. The consumption of alcohol shall not be permitted in Lela McGuire Jeffery Park.

 

Section 4. No person shall permit any pet, whether with or without a leash, to be in Lela McGuire Jeffery Park.

 

   A. A pet is hereby defined to be any animal kept for pleasure

        rather than utility.

 

   B. This section shall not apply to:

 

      (1) any guide dog, signal dog, service dog, or other animal

          individually trained to provide assistance to an

          individual with a disability;

   

      (2) dogs used by or under the authority of police or law

          enforcement agencies for law enforcement purposes; or

 

      (3) pets that are part of a special event or an exhibit at

          a special event held in Lela McGuire Jeffery Park.

 

Section 5. Whoever is convicted of or is found guilty of a violation of this Ordinance shall be guilty of a minor misdemeanor and shall he fined not more than $100.00 for the first such offense; whoever is convicted of or is found guilty of a second offense within one (1) year after the first offense shall be guilty of a misdemeanor of the fourth degree and shall be imprisoned or jailed for not more than thirty (30) days and fined not more than $250.00; whoever is convicted of or is found guilty of each subsequent offense after the first and second offense within one (1) year shall be guilty of a misdemeanor of the third degree and shall he imprisoned or jailed not more than sixty (60) days and shall be fined not more than $500.00.

 

Section 6. This Ordinance shall be in full force and full effect from and after the earliest period allowed by law.
