PUBLIC NOTICE NEW MEXICO RENEWABLE ENERGY TRANSMISSION AUTHORITY The New Mexico Renewable Energy Transmission Authority is contemplating entering into a project with Agua Fria Energy, LLC ("Agua Fria") to plan, develop, acquire, and/or finance an energy storage system ("Bosque ESS") that will provide capacity and renewable energy firming services, located in Valencia and Socorro Counties in the State of New Mexico (the "Project"). The Project will use either conventional lithium-ion battery technology or newer, long duration energy storage technologies with a capacity up to 400 MW. Once constructed, the Project will be an eligible facility, providing storage for energy from at least 30% renewable sources. The renewable projects that may use the Project's storage capacity could be connected directly to Public Service Company of New Mexico's (PNM) transmission system or connected to PNM's system through the planned RioSol Transmission Line Project via the future Tom Wray 345 kV substation. For example, Pattern Energy and Agua Fria Energy are developing renewable energy and have expressed an interest in delivering that energy to PNM via the RioSol Transmission Line. The anticipated in-service date for the Project is the fourth quarter of 2031. This notice constitutes compliance with 62-16A-4(C)(1) NMSA 1978. The BUYER also reserves the right to reject any or all bids or any part thereof, and to waive any minor technicalities. A contract will be awarded to the bidder submitting the lowest responsible bid meeting the requirements. 2.0 EQUIVALENT PRODUCT Bids will be accepted for consideration on any vehicle and conversion that is equal or superior to vehicle and conversion specified herein. Decisions of equivalency will be at the sole interpretation of the BUYER. A blanket statement that product proposed will meet all requirements will not be sufficient to establish equivalence. A brochure and floor plan of the proposed product is to be submitted with the proposal. 3.0 INTERPRETATIONS In order to be fair to all bidders, no oral interpretations will be given to any bidder, as to the meaning of the specification documents or any part thereof. Every request for such a consideration shall be made in writing. All bids must be regular in every respect. Unauthorized conditions, limitations, or provisions shall be cause for rejection. The BUYER will consider as irregular or non-responsive, any and all bids that are not prepared and submitted in accordance with the bid document and specification, or any bid lacking sufficient technical literature to enable the BUYER to make a reasonable determination of compliance to the specification. It shall be the bidder's responsibility to carefully examine each item of the specification. Failure to offer a completed bid or failure to respond to each section of the technical specification (COMPLY: YES NO) will cause the proposal to be rejected without review as non-responsive. All variances, exceptions, and/or deviations shall be fully described in the appropriate section. Deceit in responding to the specification will be cause for rejection.
