TERMS AND CONDITIONS FOR THE HITOYOSHI APP

These Terms and Conditions shall apply to all orders and data collected of Hitoyoshi Group products ("Products") of a customer through this Hitoyoshi App (the "App"). By registering an account or placing an order for Products through this App, you understand, agree with, and accept: 

(i) these Terms and Conditions and any corresponding changes thereto which we may implement from time to time; and 

(ii) our Privacy Policy in connection with how we process your personal information collected from this App.

For purposes of these Terms and Conditions, "Hitoyoshit”, "our" or "we" shall refer to Hitoyoshi Group, while "customer" or "you" shall refer to the customer who intends to register an account or purchase the Products from this App.

I. Territories Covered

You understand and agree that this App can only service selected areas covered by store under the Hityoshi Group restaurants.

II. Account Creation

If you decide to place an order through this App, you will be asked to register by creating an account which requires your personal information such as name, complete delivery address, telephone or mobile number, email address and a password. Creating an account allows you to automatically fill out necessary delivery details such as delivery address and contact number on your next order. Inputting and confirming a password on the "Register" page of the App, along with other confirmations, allows you to make an account. You must keep this password confidential and must not disclose it to anyone. If you believe someone else knows your password, please change your password immediately.

We reserve the right to suspend your registration if you violate any of these Terms and Conditions.

If you wish to order as guest, the App will require your name, telephone or mobile number and complete delivery address on every use of the ordering platform. The information you provide will only be used for the purpose of the pertinent delivery and for any subsequent issues on payment. If you are ordering as a guest, do not input or confirm any password on the pertinent pages of the App.

If another person used your account to order Products on your behalf, with or without your knowledge, such order shall be subject to these Terms and Conditions, and you agree that the order shall be considered your own and will be charged to you.

III. Fulfillment of Order

The online order submitted through this ordering platform will be fulfilled via delivery or pick up only. The delivery order is fulfilled either through riders or other third-party delivery services which we may engage while pickup is fulfilled by you based on the time and date you selected, and upon confirmation of your order by the store. We reserve the right to revise or add order fulfillment options in the future.

IV. Submission of Order

Upon submission of your online order, you are authorizing us to process your online order and preparation of the Products you have specified on your order form. However, we reserve the right to refuse the processing of your order without any notification should we find any incorrect or incomplete details, or any previous spurious transactions with the given personal information.

Also, non-response to SMS and calls from either store, or delivery rider may result in late or non-delivery of Products, or late preparation of the Products in store and should not be taken against us. Additional verification call or confirmation call may be required to proceed with your order.

V. Privacy Policy

Our Privacy Policy, and any changes thereto which we may implement from time to time, in connection with how we process your personal information collected from this App may be found in the Privacy Policy. You agree that with your acceptance of these Terms and Conditions, you have read, understood and accepted our Privacy Policy.

VI. Updating these Terms and Conditions

Whenever necessary, we may, from time to time, update and/or revise these Terms and Conditions. We shall inform you of any update or revision by placing the date of the latest version on top of these Terms and Conditions.

Hitoyoshi Group (“We” or “Hitoyoshi”) is the Personal Information Controller responsible for ensuring the privacy of the personal information you provide through the use of this Hitoyoshi App (the “App”). As such Personal Information Controller, we process your personal information in accordance with this Privacy Policy.

3. to provide you with a better service, and 
4. internal record keeping, for the following reasons:

• We may use the information to improve our products and services.
• We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided.
• From time to time, we may also use your information to contact you for market research purposes.
• We may contact you by phone or mail. We may use the information to customize the App according to your interests.

For purposes of this Privacy Policy, these purposes (other than the fulfillment of your delivery or for-pick-up order), shall be referred to as “direct marketing purposes”.

In the process of communicating with you for direct marketing purposes, we may also invite you to join communities or groups in certain messaging applications, or communicate with you via social media applications (collectively, “Applications”).  In accepting our invitation to these messaging applications or in communicating with us through social media applications, you should note that we do not have any control over how these Applications use or process your Personal Information. As such, you understand that we will not be responsible for the protection and privacy of your Personal Information which you provide in the course of your use of these Applications to communicate with us. For clarity, such Applications are not governed by this Privacy Policy. You should exercise caution and review the privacy policy applicable to the application in use.

We also share your information with our service providers, subsidiaries, affiliates and franchisees, to fulfill your order. From time to time, we may also share your personal information with our subsidiaries, affiliates, partners and franchisees for their use and processing in accordance with this Privacy Policy.

We do not sell, distribute or lease your personal information to third parties other than those stated above, unless we have your permission or are required by law to do so.

SECURITY STORAGE AND DISPOSAL

We are committed to ensuring that your personal information we collect and store is secure. To prevent unauthorized access, processing or disclosure of your personal information, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the personal information we collect online such as but not limited to data encryption and access restrictions on our databases.

We store your personal information through our authorized third-party’s secured database, which may be accessed by our service providers, subsidiaries, affiliates and franchisees for services. We retain your personal information as long as your account is active or as long as necessary to fulfill your orders. If there is no activity within thirteen (13) months, we shall dispose of your personal information in accordance with the relevant privacy rules and our internal guidelines.
