The Nam Kee Membership Program ("Nam Kee Club") is operated by Nam Kee Spring Roll Noodle Company Ltd. ("Nam Kee”) An applicant or a Nam Kee Club member (“member”) who participates in the Nam Kee Club hereby confirms that he/she agrees to be bound by the terms and conditions set out herein below and as may be amended by Nam Kee from time to time.
1. Application
To apply for Membership, applicants are required to complete the registration process via Nam Kee Nam Kee Web Order Website. Each valid mobile number or email address can be registered for application of Membership once only.
If the application is successful, the applicant can login their membership via registered mobile phone number and password.
The applicant must be aged eighteen or above.
Applicants must complete all mandatory fields in the application form in full and provide true and accurate information. Nam Kee shall be entitled not to process any incomplete or inaccurate application. The eligibility for Membership under the Membership Program is at the sole discretion of Nam Kee. Nam Kee shall be entitled to refuse any application without giving any reason.
For the purpose of providing services under the Membership Program, applicants agree Nam Kee to use the personal information provided throughout the application process for managing Nam Kee’s daily operation, such as verification of Nam Kee Club Member’s identity and record, handling the Nam Kee Members’ information, conducting market research and analysis of Nam Kee’s products and services, providing Nam Kee’s update information, enhancement of customers’ satisfaction level and responding to Members’ enquiry and/or complaint.
2. Member Bonus Points
Nam Kee membership, accumulation of bonus points is valid for one year (365 days), which is calculated from the day of membership application. Members must use the points before the end of the annual bonus points period of the points, otherwise all remaining points will be cancelled. .
For example, if the membership apply on January 6, 2023, the bonus points will be valid until January 5, 2024. During this period, all accumulated points will expire at 11:59 pm on January 5, 2024. Unused Points will be forfeit and the next points year will begin on January 6, 2024.
Except where otherwise provided, member is entitled to earn bonus points upon purchasing any items (Except designated item(s)) at Nam Kee Web Order plarform, points are calculated based on the total net amount of the transaction, not applicable on dine-in, phone-order, in-store takeaway and third-party takeaway platform.
Every purchase of $1 = 1 Bonus Point, and points will not be rounded.
Points earned will be updated within 5 working days of the transaction date.
Bonus Points cannot be transferred or transferred to others or other memberships, also cannot combined with member accounts.
No points will be replenished post purchasing in membership under any circumstances.
In case of refund request, the Bonus Points accrued from the refunded product(s) will be deducted from the Membership. Nam Kee reserves the right to take legal action and deduct Bonus Points from Membership if Nam Kee reasonably suspects that such Bonus Points were obtained via dishonest means or misconduct.
3. Membership
To login Membership Account, Nam Kee Member is required to input his/her registered mobile number and password (“Login Information”).
Members should not disclose to or allow any third party to know his/her Login Information and should not allow any third party to use his/her Membership Account. Members shall be responsible for and bound by all activities and transactions authorized or carried out in their Membership Accounts.
Nam Kee shall not be responsible, whether the Member is aware of it, for any loss or damages caused by activities carried out by stolen Login Information and in such case. Member agrees to remain responsible for any activity carried out by such Login Information or any loss caused to Nam Kee arising out of that.
Member is solely responsible for the safe keeping of his/her membership password and shall not disclose or divulge such information to any third party.
Nam Kee is not liable for any loss or damages suffered by member arising from the loss, theft or use of his/her password.
All record of Membership Account (including but not limited to membership benefits) shall be based on the database of Nam Kee, which shall be final and conclusive and binding on Members.
Members have no right to participate in the constitution, operation or management of Nam Kee nor have any right in or any claim for any asset and/or property of Nam Kee.
Member is responsible for keeping Nam Kee updated his/her mobile number and email address. Nam Kee shall not be responsible for any loss or damage as a result of or in connection with Member’s failure to notify Nam Kee of any change of mobile number or email address. Please notify Nam Kee at cs@namkee.hk via his/her registered email
Not every Member shall be eligible to participate in all promotional events of Nam Kee and Nam Kee may from time to time impose conditions on Members’ participation in any promotional event.
4. Termination
Nam Kee Club Member can terminate his/her Membership at any time by the following means:
Members can terminate Nam Kee Club membership via ’Member Home’ of Nam Kee Club webpage on their own with immediate effect. All unredeemed membership benefits including accumulated point(s) of the said Member will be cancelled and forfeited automatically forthwith by meantime, and it is unrecoverable.
System will seal the member information for 180 days after membership terminated. Re-registration is not allowed during this period. After 180 days, the member information will be automatically removed from the system.
Misconduct, fraud or misuse of membership benefits under the Membership Program or failure to comply with the Membership Terms and/or any other related terms and conditions may result in termination of Membership forthwith and all unredeemed membership benefits including accumulated point(s) will be cancelled and forfeited automatically forthwith without prior notice. Nam Kee shall not be liable for any loss or damages resulting thereof and shall be entitled to take action for recovery of any loss suffered by Nam Kee as a result of the breach of Membership Terms.
If Member discover any improper use of his/her Membership Account, he or she should immediately send notice via his/her registered email to Nam Kee at cs@namkee.hk
In the event of any dispute arising from Nam Kee Club Member, Nam Kee shall be the sole and final arbiter of such dispute and its decision shall be final and binding on an applicant and/or member.
6. Member Benefit
From time to time, Nam Kee may offer membership benefits in whatsoever means as determined by Nam Kee in its absolute discretion to Members.
Only the membership created before the member’s birthday month can enjoy the birthday offer of the current year. If the membership create within the birthday month, they will only be able to enjoy the birthday offer in the birthday month of the next year.
Members accepting the offer or enjoying the membership benefits shall be deemed to have agreed to be bound by any applicable terms and conditions which may be imposed by Nam Kee in relation to such membership benefits.
Membership and membership benefits are not transferable or assignable and are for the Member’s personal use and benefit only. Verification of Member may be required, if necessary.
Privacy
All personal information collected under the Membership Program shall be managed in accordance with the Personal Data (Privacy) Ordinance and the Privacy Policy of Nam Kee (as amended from time to time).
In the event of any breach of the Terms and Conditions of Nam Kee Club membership program, or the use of the membership is unauthorized or arises from act of misconduct, fraudulent or otherwise unlawful, Nam Kee has the right to stop one’s participation in the Nam Kee Club Membership Program and/or immediately terminate one’s membership or his/her application with or without notice. Nam Kee will not be liable for any loss or damage resulting therefrom and also has the right to take action for recovery of any loss suffered by Nam Kee as a result of the breach of the Terms and Conditions of Nam Kee Club Membership program.
Nam Kee shall be entitled to terminate the Nam Kee Club Membership Program and/or its operation at any time and at its sole discretion upon reasonable notice, where reasonably possible, without giving any reason. Upon termination of the Membership Program, all rights and membership benefits under the Membership Program shall cease forthwith. Nam Kee shall not be liable for any loss or damages resulting thereof.
In case of any dispute arising from the Nam Kee Club Membership Program, Nam Kee shall be final and binding on the applicant / Member.

Nam Kee reserves the right to amend the Terms and Conditions of Nam Kee Club Membership Program or revoke any right and/ or privilege without prior notice. All changes or amendments are effective once announced on the Nam Kee website Nam Kee. Applicant or member should regularly check whether the Terms and Conditions of Nam Kee Club Membership Program has been modified or right and/or privilege has been revoked via Nam Kee website Nam Kee as an applicant’s or member’s continued use of Nam Kee website Nam Kee indicates the acceptance of any change to the Terms and Conditions of Nam Kee Club Membership Program and/or revocation of right and/or privilege. In case of any dispute, decision of Nam Kee shall be final.
If there is any inconsistency or conflict between the English version and Chinese version of the Terms and Conditions of Nam Kee Club Membership Program, the English version shall prevail.
This Personal Data Privacy Policy (“the Privacy Policy”) illustrates the practice of Nam Kee Spring Roll Noodle Co. Ltd ("Nam Kee" or "We" or "Us" or "Our") in relation to our management of your personal data ("Data") we collect from you through our websites and/or online services, including http://www.namkee.hk and any other owned or operated websites, social media platforms and/or online services that link to the Privacy Policy (collectively the "Sites"). Any reference to "You" and "Your" when used in the Privacy Policy includes any person who accesses the Sites and/or submits Data.
Please read through the Privacy Policy carefully. By using the Sites or submitting your Data to us, you agree to accept the Privacy Policy. We have the right to change or amend the Privacy Policy at any time without prior notice. Any changes or amendments will be posted on the Sites. You are advised to check it on a regular basis. By continuing to use the Sites after the Privacy Policy is changed or amended, you are deemed to have consented to such changes or amendments.
1. Personal Data (Privacy) Ordinance
1.1 In collecting, using, storing, retaining, disclosing, transferring, providing, allowing access to, protecting and accessing Data, we shall comply with the requirements of the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong SAR).
2. Collection of Data and Information
A. When you use the Sites and/or participate the membership program managed and operated by Nam Kee (the “Membership”), we may collect Data including but not limited to your name, , contact details (including email address and mobile phone ), birthday (month & year), gender, electronic payment information , credit card details and billing information (if you place an order with us for our goods or services), IP address, operating system type, browser type, domain name, access time and other information relating to other persons relevant to the information or services you have requested, from you which will be used as follows:
B. for verification of identity and record for the purposes of providing goods and services and/or customer services;
C. to fulfill your order for goods or services and processing of such order, payment and any outstanding amounts;
D. to store contact details in our internal database;
E. to generate surveys on user traffic on the Sites;
F. to respond to and process any query from you or fulfill requests submitted by you;
G. for evaluation and further enhancement of our goods and services;
H. for conducting market surveys, research or analysis relating to our customers, goods, services, activities, promotions or events; or
to administer, operate, participate in, interact, partner or collaborate with Membership and/or customer loyalty programs, including but not limited to Membership profiles and Membership benefit.
2.1 We use third party payment services to process online transactions. When you place an order, you agree and accept that your credit card information will be collected, processed, and kept by us and a payment service provider subject to its terms and conditions. You agree and accept that you are solely and exclusively responsible for any losses incurred or sustained by you in making credit card transactions, and in no event shall any such losses in whole or in part be borne by us.
2.2 You acknowledge and agree that the provision of your Data to us is voluntary.
2.3 You may request to access, update or correct your preference with regard to the information and materials you received from us or our use of your Data by sending email to cs@namkee.hk or in writing to 21/F, Abba Commercial Building, 223 Aberdeen Main Road, Hong Kong marked to the attention of Customer Service Department.
3. Use of Data for Direct Marketing
3.1 We intend to use your Data for purpose of direct marketing by sending you the direct marketing communications, such as mail, email, telephone and SMS containing news, offers and promotions on food, beverage, catering products and services. We shall not use your Data for such purpose unless we have obtained your consent.
3.2 We are not allowed to provide your Data to any third party for direct marketing purposes without your written consent.
3.3 If you do not wish to receive any direct marketing communications from us, irrespective of whether you have participated the Membership or you have given your consent to us, you may send your request together with your name (registered one, if applicable), contact telephone number (registered one, if applicable) and email address (registered one, if applicable) to us via email at or write to 21/F, Abba Commercial Building, 223 Aberdeen Main Road, Hong Kong marked to the attention of Customer Service Department or via the Sites indicating your request to cease using your Data for direct marketing purpose by us. Upon receipt of your request, we shall cease to use your Data for direct marketing purpose within 7 working days from the date of receipt of your complete request.
4. Security
4.1 We will use adequate security technologies and procedures to protect the Data from unauthorized access, use or disclosure. However, due to the nature of the Internet and technology, it is possible that others may intercept the information you are sending to or transmitting through the Sites. We do not warrant that the Sites are impenetrable or invulnerable to hackers.
5. Disclosure, Retention and Storage of Data
5.1 You acknowledge, agree and authorize us to retain and store the Data in one or more of our databases within or outside Hong Kong.
5.2 Except with your prior consent or as permitted by law, we will not transfer, disclose, provide or allow access of your Data to any third party except as stated below:
A. our employees;
B. credit companies for payment transactions;
C. any person or organization to whom we are required to make disclosure to (i) in accordance with the requirements of applicable laws, court orders, administrative policies or regulations, guidelines or directives, (ii) orders given or issued by any regulatory, governmental, tax, law enforcement, other authorities, self-regulatory or industry bodies in or outside Hong Kong, (iii) in connection with any legal proceedings or (iv) for establishing exercising or defending legal rights in Hong Kong;
D. any person, organization or entity for the purpose of conducting due diligence in connection with our business, merger, acquisition or transfer of business;
E. any person, organization, entity or authority to facilitate identification of an individual involved in a life threatening or emergency situation; or
F. any agent, contractor or third-party service provider who provides operation, research, sale, data analysis and processing, computer technology, telecommunication, telemarketing, payment or other services in connection with our business operation, provision of our goods and/or services and Membership management and operation.
5.3 You acknowledge, agree and authorize us that we may transfer, disclose, provide or allow access your Data to execute, implement or comply with any term of our terms and conditions or the Privacy Policy.
5.4 Nam Kee shall not keep your Data longer than is necessary for fulfilment of the purposes specified above for which they are, or are to be, used.
5.5 Data provided by you is retained if the purpose for which the Data was collected still exists, it is so required by law, statute or regulation, or it is in the public interest.
6. Data Access and Correction
6.1 You are entitled to check whether we hold Data about you and to access any such Data, and if applicable, to require us to correct any inaccurate Data or update it. If you wish to access, correct or update your Data, please email cs@namkee.hk or write to 21/F, Abba Commercial Building, 223 Aberdeen Main Road, Hong Kong marked to the attention Customer Service Department or via the Sites (for change of your name, gender, address and/or password under the Membership only). We will endeavor to respond within 7 working days of your complete request.
6.2 If you wish to withdraw from Membership and/or request for removal or deletion of your Data, you may send your instruction/request together with your name (registered one, if applicable), contact telephone number (registered one, if applicable) and email address (registered one, if applicable) via email to us at or write to 21/F, Abba Commercial Building, 223 Aberdeen Main Road, Hong Kong marked up the attention Customer Service Department. Upon request of your instruction/request, we shall remove or delete your Data within 7 working days from the date of receipt of complete instruction/request.
7. Cookies
7.1 We may use cookies on the Sites. Cookies are small bits of information that are automatically stored by a website on a person's web browser in his/her computer that can be retrieved by that website. The information collected by cookies is anonymous aggregated research data, and contain no name or address information or any information that will enable anyone to contact you via telephone, email or any other means. Most browsers are initially set up to accept cookies. Should you wish to disable those cookies you may do so by changing the settings on your browser. However, as cookies are necessary for some features of the Sites to work, e.g. to maintain continuity during a session, if they are disabled, those features may not work properly and this may cause some of our webpages to display incorrectly or not at all.
8. Minors
8.1 We are not obliged to check or verify your age and assume that you are the age of 18 or above. If you are under the age of 18 or do not have the ability to enter into a contract, you should not provide any Data on the Sites without prior consent from your parents/guardians. Parents/guardians are advised to monitor their children/minors when they are online.
9. General Provision
9.1 In case of any conflict or inconsistency between the English and Chinese versions of the Privacy Policy, the English version shall prevail over the Chinese version (which is provided for information purposes only).
