The terms and conditions set out below are applicable to the use of the Identifast application (hereinafter The Application), provided by Eppical S.A (hereinafter "Eppical"), whose primary function is to provide its users with the tools to use and generate dynamic QR codes as established in this document. Before starting to use the service offered by Eppical, you must read the entire content of this document. The following general conditions make up the norms and rules established by Eppical, relative to all currently existing services, which may be included in the future within the Application. By entering or using the available functions, you (USER) declare full acceptance of the terms and conditions set forth herein. If the user does not agree with them, they must immediately leave the platform and refrain from using it.
The final purpose of the Identifast Application is to generate a next-generation user experience in access controls, with the most advanced security levels, using dynamic QRs
1. Object
The current Terms and Conditions are intended to define the conditions under which you agree to use the Application provided by Eppical
2. Modification of the Terms and Conditions
Eppical may at any time and without prior notice modify these General Conditions. Such modifications will be operational as of their posting in the Application. Users must stay updated regarding the terms included here by periodically accessing the terms and conditions section.
3. User
The Services may be requested by any natural or legal person, as long as they accept the present terms and conditions, as well as Eppical's privacy policy. We will ask each user or administrator to enter their phone number. The user is entirely responsible for maintaining the confidentiality of his/her user. You agree not to use another user's account at any time or disclose your username to any third party. You agree to immediately notify Eppical in the event that you suspect unauthorized use of your account or suspicious access to your username. You are solely responsible for the use of your account. The user accepts this license and The Application as is, this is without any implicit or explicit warranty, and waives any action against Eppical and/or its representatives in connection with the operation of The Application.
4. Relationship between Eppical and Users
Eppical does not intervene in any way in the interaction between hosts and guests. Consequently, Eppical does not exercise any control over the quality, conformity, security or legality of the information, its altered nature or not, the veracity or accuracy of the contents of the data generated by users.
5. Eppical Ownership of the Application Content
The content may not be copied, distributed, framed, reproduced, downloaded, displayed, published, transmitted or sold in any way or by any means, in whole or in part, without the prior consent of Eppical. Any use of the content of The Application other than that provided for in this document, or in contravention of applicable legislation or the rights of third parties is strictly prohibited and will result in the cancellation of the right to use it. Eppical may terminate this right of use at any time, with or without cause and without prior notice.
6. Responsibility within the framework of access to the Application
Eppical (including its employees, management or anyone involved in its creation, production or delivery of the system) is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorized access to or alteration of any communications with any user. Eppical reserves the right to temporarily suspend access to its services for technical or maintenance reasons without these operations being entitled to any compensation. Eppical undertakes to limit, to the extent of its possibilities, these types of interruptions. Eppical is committed to providing the best security and confidentiality of the data provided, in the case of using the Application.
7. Intellectual property rights and personal rights
To the extent that we receive notification of an unlawful use or violation of the terms of service and privacy policy of this document, or that may constitute an attack on the rights of a third party, we reserve the right to delete or deactivate access to the Application for the persons concerned and/or suspend User accounts. If you verify the non-respect of intellectual property rights or the rights of a person in an element published on the site, you can send a written notification by email to the address contacto@identifast.com
8. Appropriate user conduct
The user agrees to upload complete and reliable information into the system and keep it updated. The user guarantees that no display of information, no element of their Profile or published by the user in the application violates the rights of third parties or is against the applicable law, whatever its nature, whether provincial, state, national or international or the regulations in force; Eppical reserves the right to take any action it deems appropriate, including the removal of prohibited or erroneous content, including any necessary legal action. Among other things, the user agrees not to: use the Services of the Application in an illegal manner or in conditions that may damage, disable, overload or alter the system use automatic scripts with the intention of stealing information using the application; disseminate, publish, or store illegal content in the Application; impersonate another person or entity, falsify or disguise your identity, your age or your affiliation with a person or entity, or create any false identity; disseminate any personal information relating to a third party, such as addresses, telephone numbers, email addresses. The foregoing provisions are prohibited and will be grounds for the sanctions and/or procedures contemplated therein, without prejudice to the legal actions that Eppical and/or its representatives and/or successors may file for their purposes.
9. Copyright
The user acknowledges that all intellectual property rights over the applications, brands, names, domain names and logos referred to in this contract are the exclusive property of Eppical, agreeing not to copy, reproduce, translate, modify, adapt or create in any way works derived from or based on this application, nor on the documentation that is part of it. Likewise, the user is prohibited from copying the source code in whole or in part, as well as from disclosing or participating in any of the applications whose use is granted here to third parties. Eppical is protected by Argentine laws and international copyright protection treaties. The user may not make direct and/or indirect use of the name, logos, domain names, or any other distinctive element of the brand.
10. Suspension and/or cancellation of the provision of the Service
Suspending the Service implies temporarily not allowing the User access to the Application, and therefore to all the data entered and/or uploaded therein, for the duration of the suspension.
Canceling the Service implies definitively not allowing the User access to the Application, and therefore to all the data entered and/or stored in it.
Consequences of suspension and cancellation of service
The User accepts that the consequences of the suspension of the Service, while it lasts, are that:
1) The User will not be able to access the Application platform by any means.
2) The User may not modify, withdraw and/or consult the Information entered on the platform, until the cause that gave rise to the suspension of the Service ceases.
While the suspension of the Service lasts, Eppical will securely and exclusively guard the Information provided by the User, in accordance with the provisions of the Personal Data Protection Law (Law No. 25,326), and will return the same to the User. at your request, only after the situation that gave rise to the suspension or cancellation of the Service has been regularized, as appropriate.

11. The terms and conditions for accesses generated through the application are as follows
At Eppical we care a lot about your comfort, but also about your safety and that of your Community, that is why it is very important that you read and accept these Terms and Conditions (the “Terms” hereinafter), which we understand have been read, understood. and accepted by you, at the time of registering in the Application.
Introducción
We tell you that Eppical has developed a system for accessing people for events organized by Identifast users and/or any other platform that becomes available in the future.
So, if you want to organize an event and make the invitation process simpler, faster, more comfortable and secure, you can do it through The Application. However, you should always know that the safety of your community depends on prudence and the good use given to this tool. Therefore, as a first measure, we suggest that if you do not agree with this invitation system, do not fully understand how it works, and/or have any doubts about it, immediately abandon these Terms, and with it Identifast.
Likewise, do not hesitate to contact us to clarify any questions in this regard, through the communication channels that we have available to users and/or contact the administrative user of your own community via any of the platforms that Identifast has available.
Algunas aclaraciones:
Community: place to which the organizing user belongs, and/or where the common space is located, and/or the unit where a specific event is going to take place.
User: any person who is part of a specific Community has the right to register and access Identifast.
Organizing user: is the user of the Identifast system who organizes an event on his or her property and/or in a common space of the community to which he or she belongs.
Guests: people who were enabled and/or authorized to enter a specific event, organized by an organizing user.
Event(s): any meeting of two or more people (including the organizing user) that takes place in the organizing user's unit and/or in a common multi-use space of the community to which the organizing user belongs.
Guard and/or Doorman: refers to the person or persons in charge of receiving visitors, guests and/or owners of a specific community, and authorizing or not authorizing their entry, after validating their identity.
Terms and Conditions: refers to this document, which is understood to be accepted without limitation or reservation by the organizing users who use Identifast to organize their events.
Prior clarification from Identifast users
Every user of the services provided by Identifast, or that are provided through Identifast, declares to accept and know without reservation that by the mere fact of registering and/or using any of its platforms and/or services they currently have and/or are provide Identifast, and those that it has and/or will be provided in the future, through its app and/or any other platform that arises and/or develops in the future, which assumes without limitation all the risks of the organization. of an event in your unit and/or common space, and that you are exclusively and absolutely responsible for everything that may occur due to your acts and/or omissions, and those of the people authorized to participate in your event within the community. In particular, all organizing users declare that they accept that they are responsible for any type of injury and/or damage that may be caused to their person, unit, and/or common space, as well as to the space of third parties and things, and/or to third parties. particularly, that they are produced on the occasion of an event organized by the organizing user, without prejudice to the liability that may later be claimed by third parties for whom it must not be responsible, excluding Identifast, the company that owns it, and its directors, partners, associates, controlling, controlled and/or subsidiaries. Likewise, the organizing user is responsible for the correct use of the Identifast app, and for the events organized through it, and declares that in the event of damage and/or causing any damage to their own things and/or those of third parties , and/or third parties, will respond personally until the incident is repaired if possible, and/or compensate the appropriate party.
The organizing users also assume the responsibility of absolutely and carefully respecting and ensuring that their guests respect all current laws. Every Identifast user absolutely disclaims all liability to Identifast, and to the company that owns it, as well as its directors, partners, associates, controllers, subsidiaries and/or subsidiaries, and renounces making any type of claim against Identifast. , to the company that owns it, its directors, partners, associates, controlling, controlled and/or subsidiaries, for any damage and/or harm that may occur, and personally assumes the civil and/or criminal liability that may correspond, guaranteeing the indemnity of Identifast of the company that owns it, of its directors, partners, associates, controllers, controlled companies and/or subsidiaries. Always remember that you are the sole and exclusive responsible for the people and things that enter your community through an event organized by you, whether you have authorized them remotely and/or in any other way.
Under this premise, we inform you that:
(a) In the case of events in common multiple-use spaces (e.g. SUM), you can invite as many people as the capacity that the community and/or municipality assigned to the space, and you are one of those people, so You must take all this into account when organizing an event;
(b) If it is a private event and it will take place in your unit (lot, home or other), there will be no limit on the number of people imposed by your community (unless the regulations provide for it), but always remember the duty to comply with the laws and regulations in force in your area. This implies that you accept without reservation that you are solely responsible for the number of guests in your unit.
In both cases you will have the limit in relation to the contracted plan.
(c) When sharing an invitation via WhatsApp or other means, you assume full and exclusive responsibility that:
1- the message was shared to the person you wanted, and that their data will be reliably completed;
2- the person receiving the invitation will not forward or share the message to other people not invited by you or on other social networks, open and/or closed.
(d) Before the event, you must / may delete, block, eliminate and/or uninvite any person included in the final guest list, if you do not do so, for any reason whatsoever, it is understood that the list was verified and accepted by You, and you will be exclusively and exclusively responsible for all the people who appear on the guest list and enter the community.
(f) The fact that you have made a list of guests, and that they have previously accepted the invitation, does not prevent the guard and/or doorman of your community from carrying out relevant security acts. Therefore, your community never loses the ability to:
1- register your guests' vehicles
2- ask for their personal information (from the driver and his companions)
3- request the presentation of your current identification document and/or valid driver's license (for the driver and his companions)
4- call you by phone / intercom to authorize access and/or corroborate some information
5- Carry out everything that is deemed necessary and convenient for the safety of you and your community.
(g) The data of the event you organize is protected by Law 25,326.
(h) Massively disseminating an invitation for you implies improper use of the Identifast system that puts the community where you are going to carry out the event of which you are a part at risk, and may be penalized;
(i) Mass dissemination of an invitation by your guest and/or a third party also implies improper use of the Identifast system for which you may be penalized, and at the same time implies a legal violation in accordance with the provisions of Law 25,326. Therefore, Identifast reserves the right to take legal action in such cases.
j) If a guest from the list approved by the organizing user of the event enters the community and carries out acts for which responsibility arises, the organizing user accepts that he is exclusively and exclusively responsible for the consequences thereof, in accordance with prior clarification from Identifast users.
(k) Identifast may save the approved list of guests to the event of the organizing user, and the data it contains (including the time and departure of each guest).

12. Biometric Devices
a) Identifast may market or integrate with Biometric hardware, RFID or any future access technology. The client accepts and acknowledges that Identifast is not responsible for the correct functioning of said devices. The client also accepts that Identifast only limits its responsibility to the operation of the Identifast system and is unrelated to the operation of the hardware.
b) The Client accepts that the hardware devices are external to Identifast and that they may fail or make erroneous readings, with Identifast being exempt from any responsibility.
c) Identifast informs that the validation of biometric data when authorizing access is the responsibility of the company that developed the hardware or biometric system contracted by the Hardware company.
d) If there is any doubt when enrolling a person or when authorizing access, the administrator, neighbor or security company must take the necessary precautions to guarantee security. Accepting that Identifast is third party and not responsible.
e) Identifast informs and the client accepts that in the event that the reading of the biometric data is taken through the Identifast application, Identifast is only a means and the responsibility for the biometric reading and access authorization is the responsibility of the client and/or Biometric hardware or software company.
Privacy and Confidentiality of Information Policies

3. Order of competent authorities - Legal Requirements
Identifast may disclose the Personal Data of its users at the request of the competent judicial or government authorities for the purposes of investigations conducted by them, even if there is no executive or judicial order or subpoena, or for example (and without limitation to this case) when whether they are investigations of a criminal or fraud nature or those related to computer hacking or copyright violation. Identifast may (and users expressly authorize) communicate any Personal Data about its users for the purpose of complying with applicable regulations and cooperating with the competent authorities to the extent that we, at our discretion, consider it necessary and appropriate in relation to any investigation of an illegal act. or fraud, infringement of industrial or intellectual property rights, or other activity that is illegal or that may expose Identifast or its users to any legal liability. This right will be used by Identifast at its sole discretion when it deems it appropriate or necessary to maintain the integrity and security of the Community and its users, to enforce the Terms and Conditions and other Policies and in order to cooperate with the execution and compliance with the law.
Each company has its own separate privacy policies. Although we choose our business partners carefully, we cannot make any representations regarding the privacy and security of those sites. Your phone is the key to access your account.
Identifast is not responsible for illegal interception or violation of its systems or databases by unauthorized persons. Identifast is also not responsible for the improper use of the information obtained by these means.
4. Rights of access, cancellation and rectification of personal information
Users have recognized and may exercise the rights to access, cancel and update their Personal Data, as well as to oppose its processing and to be informed of the transfers carried out, all in accordance with the provisions of Law No. 25,326 on Protection of Personal Data. Users guarantee and are responsible, in any case, for the veracity, accuracy, validity and authenticity of the Personal Data provided, and undertake to keep it duly updated. You can modify or change any information that you have previously provided to us at any time, from “Settings”. Changes will be updated immediately. You can also contact us and we will be happy to change, modify or delete any information for you.

Identifast may modify the terms and conditions of these Privacy and Confidentiality Policies at any time.
If we decide to make any material changes to our Privacy Policies, we will notify you by posting an updated version of the Policies in this section.
If we make material changes to the way your Personal Data is managed we will notify you so that you can make an informed decision as to whether or not you agree to your Personal Data being used in that way. If you do not accept these terms, in that case the contractual relationship will be dissolved and your Personal Information will not be used in any other way than that which was informed at the time it was collected.
6. Transfer of data to third parties
Identifast informs the visitor that acceptance of this Privacy Policy implies that he or she grants his or her consent for Identifast to assign, transfer, share their data to its affiliates, controlled, linked, related and/or to any third party, who may use them to communicate with You and/or organize, design, prepare, segment and/or direct advertising promotions, marketing actions, direct sales and/or send you communications related to any of the products they market and produce and/or other similar activities and/or to any other purpose related to the purposes of providing you with your services. Likewise, acceptance of this Privacy Policy implies that the visitor gives their express consent for the transfer of their information even when any of the above mentioned are in countries that do not have the same levels of privacy as Argentina.
