VOTING RULES AND REGULATIONS

The VOTING RULES AND REGULATIONS as contained herein shall be binding on each and every individual, who participates in the voting activity (“Voting Poll”) by casting his/her vote, using the Voting Mechanism (as defined below), for the Shortlisted Participants (as defined below) competing in the program titled ‘Big Boss - Season 17’ (“Program”) being aired on “Colors”, (hereinafter collectively referred to as “Channel”) and on also streamed on Jio Cinema application (“Platform”), being the Channel & Platform owned and operated by Viacom18 Media Private Limited (“Viacom18”). The Principal Voting Rules and Regulations and General Rules (hereinafter collectively referred to as “Rules and Regulations”) are stated hereunder.

The Rules and Regulations in relation to the Poll as stated herein is an electronic record in terms of Information Technology Act, 2000 ("Act") and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology (Amendment) Act, 2008. This is a legal and binding agreement between the Applicant /Participant (as defined hereinafter) and Viacom18, that states the terms that govern the Voter’s participation in the Poll through the Jio Cinema App / Website (as stated hereinbelow) and/or any other platform as communicated hereunder. By participating in the Poll, the Voter hereby explicitly, unconditionally, affirmatively, consents, agrees and undertakes to abide, be bound by and adhere to the terms and conditions stated herein.
Viacom18 is conducting the voting process in order to enable the voters to save their favourite Participants in the Program from elimination and eventually making them the winner/s of the Program. This Poll is open for all individuals residing in the regions as stated hereinafter and above.

Eligibility: This Voting Poll is open for the individuals who (“Voter”):

a) Are citizen of India holding valid proof of citizenship and are residing in India;
b) Is an adult (being a person of legal age and can enter into a contract in accordance with applicable laws of India) and have access and/or subscribed to Jio Cinema and authorize such access to any child/children of above 18 (eighteen) years of age;
c) Are viewers of the Program on Channel
d) Have downloaded Jio Cinema Application (“App”) and registered themselves on the said App; and
e) Agree that he/she will be required to submit all valid proofs of name/ age/ address/ nationality/citizenship and/or any other document if and as may be required by Viacom18 from time to time;

The Voter hereby agrees to have read and understood all the rules and regulations for participation in the Voting Poll and agrees to abide by the same.

PRINCIPAL VOTING RULES AND REGULATIONS:

1. The Program is a reality show where individuals/housemates (“Participants”) staying in the Bigg Boss House will nominate housemates for eviction from the Program (“Shortlisted Participant”). During the Program, the Voters will be asked to cast their vote for the Shortlisted Participant whom they want to save from eviction from the Program. The Shortlisted Participant who gains the minimum votes from the Voters, will be eliminated from the Program.
2. Further, Viacom18 and/or the Channel shall be entitled to, at its discretion any time during the telecast of the Program, re-introduce the eliminated Participant(s) or introduce fresh individuals/participants (“Wild Card Entries”).
3. From 15 October 2023 onwards, the Channel will telecast the episode(s) of the Program at the timings stated below:
(i) 21:00 hours IST on Saturday & Sunday;
(ii) 22.00 hours IST from Monday to Friday;
4. The votes, for each of the episode, should be sent only during the Voting Cycle, as more particularly mentioned as set out below. Votes sent after the Voting Cycle, shall not be considered as valid and shall be deemed null and void.
5. To participate in the Voting Poll, the Voter must watch the episodes of the Program being telecast on the Channel. The Voter(s) by participating in the Voting Poll will get an opportunity to cast their vote for the Shortlisted Participants participating in that episode(s) of the Program.
6. The Voters interested in the Voting Poll can participate as per the Voting Mechanism mentioned below and shall be subject to the it’s requirements and rules.
7. Voting Mechanism: The Voter understands that in order to vote in Voting Poll, the Voter will be required to download the App, follow the registration process as displayed therein and vote in the manner as prescribed hereinafter. Whereas the detailed instructions shall be more particularly available on App at time of voting, brief steps/ participation process shall include as follows:
(i) Only Voters residing in India and using valid Indian phone number which are duly registered with the network operators can participate through Voting Mechanism;
(ii) The Voter needs to mandatorily download the App (either on iOS, Android and/or Windows) to cast his/her vote using the Voting Mechanism.
(iii) After properly downloading the App, the Voter needs to login by using their mobile number.
(iv) If a Voter is an existing subscriber/user then the Voter can log in the App using his/her user ID and password.
(v) Once the Voter successfully logs into the App, he/she can cast his/her vote for the Shortlisted Participant he/she desires for a particular episode of the Program, as per the details mentioned on the App and Rules and Regulations mentioned here. The vote should contain the keyword assigned to each of the Shortlisted Participant of the Program for each respective episode of the Program.
(vi) After casting the vote, as per the Rules and Regulations mentioned here, the Voter should log out/sign out of the App without fail. Any failure or usage of the App by any unauthorized party, will not be considered by Viacom18 or the Platform to allow a Voter to vote again or withdraw any vote.
8. The Voter should cast his/her vote for a particular Shortlisted Participant, for respective episodes of the Program, during a particular Voting Cycle hereinbelow and any vote being cast after the Voting Cycle shall neither be considered as a valid vote for that episode nor for the next Voting Cycle.
a) Tentative voting cycle for the entire season: 15 October 2023 to 15 January 2024

b) For every episode of the Program, the period starting from Voting Start Date and Time and ending on Voting End Date and Time will be considered as voting cycle for that particular episode (“Voting Cycle”).
c) The Voting Poll will tentatively start from 11 P.M. (IST) on Monday and end on 11.P.M. (IST) Thursday for the Shortlisted Participant for that week, subject to changes as per the discretion of Viacom18.
d) Any change in Voting Cycle will be notified by the way of Astons on-air in the Program specifying the end time of voting.
9. The Voters who use the Voting Mechanism understand and acknowledge that as per the Rules and Regulations, the maximum number of votes that he/she can cast, for their favourite Shortlisted Participants per episode, through one (1) login ID/contact number during the Voting Cycle, is limited to 1 (one) vote per user/contact number per Shortlisted Participant.
10. The votes sent after the first vote of any user and email ID, shall not be counted and will be considered null and void. Thus, for e.g., a viewer has sent 10 votes per episode, during the Voting Cycle, then the vote cast by the viewer vide his/her user and login ID/contact number after the 1st vote for that particular episode during that particular Voting Cycle will not be counted and would be considered null and void.
11. The vote through any of the Voting Mechanism will be deemed to have been cast and received only when such vote reaches the server of the concerned telecom/ internet service provider and such vote as received by the telecom/mobile/internet operator shall be considered for the purpose of counting. Any unclear/incorrect/incomplete vote and/or absence of valid user and login ID, incomplete vote, shall be considered as an invalid vote and shall deem to be null and void.
12. Neither Viacom18 nor the Channels and/or Platform shall be responsible in case of any kind of network problem, technical failure whatsoever and/or the data charges/costs charged by the network operator(s) and/or any other problems which may occur due to the failure of the Voting Mechanism or misuse of the Voting Mechanism inability to cast vote due to any other technical issue and/or any other reason whatsoever and/or any kind of problems in connection thereto. Any dispute in connection to the same shall be settled directly between the viewer/subscriber and the operator(s) without involving Viacom18 and/or the Channel and/or Platform in any manner and at anytime, whatsoever.
13. Viacom18 shall use reasonable security and technical measures to prevent unauthorized access to user data and/or for any compromise on private/confidential user related, or any other data, including but not limiting to user IDs, email address, names, contact numbers and/ or any other user-related details. The terms of the Privacy Policy and Terms of Use available on https://www.jiocinema.com/ govern the Voters use of the App and the information accessible on or from the App. By accessing and/or using the App, Voters signify the Voters agreement to accept this Privacy Policy and Terms of Use.
14. In case of any network failure, technical problem and/or for any reasons whatsoever, Viacom18 reserves the right to change the voting system/Voting Mechanism and/or cease from accepting votes of the Voters for any and/or all the episode(s) of the Program or take such necessary steps as it may deem fit without any liability to any viewer/person/ party.
15. Upon the Voters’ voting for the favourite Shortlisted Participant, the user and login ID and/or contact number from which the Voter has voted during the Voting Cycle will get registered with the respective network provider(s) who will collate the total number of votes received for each Shortlisted Participants and send the same to Viacom18.
16. For a particular Voting Cycle, the Voters can cast their votes only for those selective Shortlisted Participants, whose details have been provided/broadcasted during the telecast of the episode of the Program. Any votes sent by the Voters for the Participants/Shortlisted Participants who were not a part of that particular episode due to elimination or not shortlisted for any other reason whatsoever, will not be considered and shall be null and void.
17. Viacom18 shall have the sole discretion to bring any eliminated Participant back in the Program as a Wild Card Entry for participation in the further rounds of the Program and thereafter such Wild Card Entry shall be subject to the voting pattern stated in this Rules and Regulations. In no event shall the Participant, viewer(s) or Voters dispute the decision made by Viacom18 and/or the Platform in this regard.
18. It is expressly stated that this is a Poll to enable the Voters to give them a chance to save their favourite Shortlisted Participant from getting eliminated in the Program. Therefore, there are no winners being declared or any prize(s) being distributed for participating in the Poll.
19. The elimination of the Participant and/or the decisions made by judges of the Program, Viacom18 and/or the Platform shall be final and binding and in no event shall the viewer(s) dispute the decision made by the judges of the Program, Viacom18 and/or the Platform.
20. The Voting Poll will begin at the time as mentioned above however Viacom18 shall have the sole right to modify the timings and commence the Voting Poll before or during the nomination announcement of Shortlisted Participants in the Program’s on-air episode.

GENERAL RULES

A. Viacom18 and/or the Platform reserve all rights to make any amendments to the existing Rules and Regulations of the Poll, and/or withdraw the Poll and/or, change the schedule of the episodes of the Program and/or, Shortlisted Participants of the Program and/or the Voting Mechanism and/or any other details of the Program etc., at any time, without any prior notice to the voters. It shall be the sole responsibility of the Voters to check the Rules and Regulations of the Voting Poll for the Program on the Website of Viacom18 and all the Voters shall be bound by any such amended Rules and Regulations.
B. LIMITATIONS OF LIABILITY: BY ENTERING THE VOTING POLL, EACH VOTER ACKNOWLEDGES AND AGREES THAT: (I) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THE VOTING POLL OR PROGRAM ETC. SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; AND (II) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED AND ASSOCIATED WITH ENTERING THE VOTING POLL (IF ANY), NOTWITHSTANDING THE FOREGOING, UNDER NO CIRCUMSTANCES WILL VIACOM18 AND/OR VIACOM18 ENTITIES BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL PUNITIVE, OR INCIDENTAL DAMAGES OR LOST PROFITS, WHETHER DIRECT OR INDIRECT, ARISING IN ANY WAY WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE.
C. The Voters who vote in this Voting Poll agree that he/she shall hold harmless the Platform, Viacom18 and its affiliates, and their directors, officers, employees, partners, representatives or any other person in relation to any injury/damage/harm/loss suffered by him/her, in any manner, whatsoever in connection with the Poll and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum anywhere in the world against the Platform and/or Viacom18 and/or the producer and /or sponsor to claim any damages or reliefs’ and/or otherwise.
D. The Platform and/or Viacom18 is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the Voter/s in any manner whatsoever, in connection to the Poll.
E. Viacom18 and/or the Platform reserves the right to disregard the vote(s) in the event Viacom18 observes any irregularity in the voting pattern of the vote(s) sent by the viewer(s) and/or if Viacom18 in its knowledge has reason to believe that the viewer(s) has acted in a fraudulent manner and/or engaged in any deceitful activity in sending the said vote(s).
F. Employees of and/or consultants of and/or persons hired on contract by the Platform, Viacom18 and the main sponsors of the Program, if any, and the members of their immediate family are ineligible for voting for the Program through this Poll.
G. By the act of voting by the viewer(s) it is deemed that the Voter has checked, read and understood these Rules and Regulations and the Voter agrees to all the terms, Rules and Regulations stated herein and also agrees that he/she shall be bound by these Rules and Regulations and further shall hold harmless the Platform, Viacom18 and its affiliates, and their employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her, in any manner, whatsoever in connection with the Program and/or otherwise and shall also not file in person and/or through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum anywhere in the world against the Platform and/or Viacom18 to claim any costs, damages and/or relief’s and/or otherwise.
H. All decisions made by Viacom18 and/or the Platform shall be final and binding on all the Voters and in no event shall the Voter dispute the decision made by Viacom18, Platform and/or its employees in connection to the same.
I. The elimination of the Participant(s) / Shortlisted Participant(s) and/or the decision(s) made by the Platform and/or Viacom18 regarding the Program shall be final and binding on all the Voters and in no event shall the viewer(s) dispute the decision made by Viacom18, Platform and/or its employees in connection to the Program and/or otherwise.
J. The terms of this Rules and Regulations shall be construed in accordance with the laws of India and in case of any dispute or any other matter arising in reference to the Poll shall be subject to the exclusive jurisdiction of the Courts in Mumbai.
