Petition of CMStP&P, April 28, 1961 The printed court case reports included published court documents from significant state and federal cases in which Great Northern was plaintiff, defendant, or appellant. The most voluminous documentation comes from a federal case (1909-1911) that sought to value Great Northern properties and arrive at a fair rate of return in setting rates.

Case files come from the Seattle office and document the body of case work originating in the west end, including the substantive California Extension case (1923-1933), by which Great Northern petitioned the ICC to permit a link with the Western Pacific Railroad in northern California. Extensive files document the Seattle office's role in planning and defending the proposed merger that eventually (1970) resulted in Burlington Northern Inc.

John S. Kennedy, et al. v Great Northern Railway Company, et al.: United States Circuit Court District of Minnesota, Third Division

On June 15, 1906 the Minnesota Railroad and Warehouse Commission began a large project to evaluate the physical properties of the railroads operating within the state. They intended to arrive at dollar figures that would indicate the cost of reproducing the physical property located within the boundaries of Minnesota. In 1906 the railroad compiled and presented to the Commission their own cost figures. In 1907 the Commission followed up with its own study yielding a second set of estimated cost figures. The purpose was to determine the total value of property as a basis for determining what, with regard to annual earnings, would provide a fair return on investment for the railroad. The establishment of fair rates of return figures then provided the basis for computing freight rates that would henceforth be promulgated by the Commission.

The court case documented by these records represents a suit inaugurated to challenge the reproduction cost figures claimed by the Great Northern as a result of its own appraisal.

These files cover a variety of suits brought against Great Northern by individuals, companies, cities, and the federal government plus suits initiated by Great northern for condemnation proceedings and for payment of debts.

Each case includes the name, the court in which the case was tried, and the court's case file number.

Arrangement: The Seattle case files are arranged according to their legal department case file numbers, beginning at 2363 and running through 3326. In addition, there are cases at the end of the series that do not bear case file numbers. These are filed according to the box and file number given them when they were accessioned by the Society.
