SCOPE AND CONTENTS
On August 29, 1905, the district court found against the MCPC, ruling that the purposes for which it sought to condemn lands were not all public uses, but involved private uses, and therefore the laws of eminent domain as stated in Minnesota Statutes did not apply. It also ruled in favor of an attached petition to appoint a commission to determine the amount of damages to be awarded to those whose lands had been involved.
The MCPC immediately appealed the decision to the state supreme court and asked it to also dismiss the petition. The petition was dropped in district court on September 7. The supreme court, however, upheld the lower court's judgment and order on April 18, 1906.
