There is no evidence that allowing transgender people access to bathrooms aligning with their gender identity jeopardizes safety and privacy. Research consistently finds that transgender people report negative experiences like harassment and violence when accessing bathrooms. In this paper, we show that the benefits of gender-neutral bathrooms are much broader. First, our simulations show that gender-neutral bathrooms reduce average waiting times: while waiting times for women go down invariably, waiting times for men either go down or slightly. Gender-neutral bathrooms sound inclusive but often fail transgender people.

But these policies are blanket prohibitions, regardless of the facts on the ground and lack of evidence showing that there are any safety concerns involved with trans students using either restroom. Hence, equal protection requires that bathrooms be made available based on gender identity.
