About the Platform Welcome to Peykyar (the “Platform”, which includes both our website and mobile applications”), operated by Magnetar Technologies Pty Ltd (ACN 689 803 110) (“Peykyar”, “we”, “us”, “our”). The Platform is available via www.peykyar.com.au, www.peykyar.com, and our mobile applications. The Platform facilitates interactions between: Shippers – individuals or businesses seeking to send goods (including where the Traveller purchases goods on behalf of the Shipper before delivery); and Travellers – individuals or businesses transporting goods, which may include purchasing goods for Shippers and delivering them. The Platform enables Shippers and Travellers (together, “Members”) to locate, communicate, arrange payment, and complete deliveries in a secure and efficient manner (the “Services”). Peykyar integrates Trustap services for secure transaction management and dispute resolution. Peykyar does not transport goods itself, act as a courier, or provide logistics or postal services. Access to and use of the Platform, or any of its associated products or Services, is provided by Peykyar. By using, browsing, and/or reading the Platform, you signify that you have read, understood, and agree to be bound by these Terms of Use (the “Terms”). If you do not agree to these Terms, you must immediately cease usage of the Platform, or any of its products or Services. Peykyar reserves the right to review, update, and change any of the Terms at its sole discretion. When we update the Terms, we will take reasonable steps to notify you (including via email or in-app notification). Any changes to the Terms will take immediate effect from the date of publication. Continued use of the Platform after updates constitutes your acceptance of the revised Terms. We recommend you keep a copy of these Terms for your records. 4. Acceptance of the Terms You accept these Terms by: Using or browsing the Platform; Clicking to accept or agree to the Terms where this option is made available to you; or Registering for an account on the Platform. If you are accepting these Terms on behalf of a business or organisation, you confirm you have the authority to bind that entity to these Terms. 5. The ServicesDelivery Risk Notice: As Peykyar facilitates deliveries via independent travellers, all delivery timelines are estimates only. Delays may occur due to circumstances beyond Peykyar’s control, including but not limited to travel disruptions, customs clearance, and weather conditions. Users acknowledge and accept this inherent risk when engaging the Services.
To access the Services, both Shippers and Travellers are required to register for an account through the Platform (“Account”). As part of the registration process, or as part of your continued use of the Services, you may be required to provide personal information (such as identification or contact details), including but not limited to: Full legal name; Date of birth; Residential address; Email address; Mobile phone number; You warrant that any information you provide to Peykyar during registration and ongoing use will always be accurate, complete, and up to date. Once you have completed registration, you will become a registered Member of the Platform and agree to be bound by these Terms. You may not use the Services and may not accept the Terms if: You are not of legal age to form a binding contract with Peykyar (18+ in Australia); or You are prohibited from receiving the Services under the laws of Australia or any other jurisdiction in which you are located or from which you access the Services. 6. Your Obligations as a Member As a Member, you agree to: Not share your account or profile with any other person; Use the Services only for lawful purposes and in compliance with: These Terms; and All applicable laws, regulations, and generally accepted industry practices in relevant jurisdictions; Be solely responsible for protecting the confidentiality of your password and login credentials; Immediately notify Peykyar of any unauthorised use of your account or breach of security; Not impersonate another Member or use another Member’s credentials; Ensure any content you broadcast, publish, upload, transmit, post, or distribute via the Platform (“Your Content”) is accurate, correct, and up to date, and maintain reasonable records of Your Content; Not harass, impersonate, stalk, threaten, or abuse another Member; Only use the Platform for the purposes of the Services authorised by Peykyar; Not use the Platform for any unauthorised commercial purpose unless approved by Peykyar management; Not use the Services or Application for any illegal or unauthorised purpose, including collecting email addresses for unsolicited messages, unauthorised framing, or linking; Accept that commercial advertisements, affiliate links, and other forms of solicitation may be removed from your profile without notice, and that any such conduct may result in termination of your Services; Accept that automated use of the Platform (including bots, scrapers, or crawlers) is prohibited; and Comply with all customs, import/export, transport, and prohibited item regulations applicable to your transactions (as detailed in the Prohibited Items clause). 7. Introduction Welcome to Peykyar, operated by Magnetar Technologies Pty Ltd (ACN 689 803 110) (“Peykyar”, “we”, “us”, “our”). Peykyar is a delivery coordination platform, available via www.peykyar.com.au, Trustap Services:The Peykyar Platform integrates buyer protection and transaction management services provided by Trustap Ltd (“Trustap”). By using Peykyar, you acknowledge and agree that: You are entering into a direct relationship with Trustap for transaction processing and dispute resolution. Your use of Trustap is governed by Trustap’s Terms of Service at https://www.trustap.com/terms and related policies. Any updates made by Trustap to its Terms automatically apply to your use of Trustap services through Peykyar. Any updates made by Peykyar to these Terms automatically apply to your continued use of the Platform. KYC (Know Your Customer) Verification:KYC identity verification is conducted solely by Stripe, Inc.. Peykyar does not store or have access to any KYC documents; we only retain full name, email address, phone number, and residential address for account operation purposes. By accessing or using Peykyar, you agree to be bound by these Terms. If you do not agree, you must immediately stop using the Platform. 8. Acceptance of Terms You accept these Terms by: Registering an account on the Platform; Clicking “I Agree” or similar in our interface; or Using any part of the Platform. If you are using Peykyar on behalf of a company or organisation, you confirm you are authorised to bind them to these Terms. 9. Eligibility To use Peykyar, you must: Be at least 18 years old and able to enter into legally binding contracts; Not be prohibited from using the Platform under the laws of Australia or your local jurisdiction; and Successfully complete KYC verification via Stripe. 10. Services Scope Peykyar provides: An online marketplace for Shippers and Travellers; Communication tools between Members; Integration with Trustap for secure payments and dispute resolution; and Account management features via our website and mobile applications. Peykyar does not guarantee delivery times, safety of goods, or compliance with customs regulations — these are the sole responsibility of the Shipper and Traveller. 11. Member Obligations When using Peykyar, you must: Provide accurate, complete, and up-to-date account information; Keep your login credentials secure and not share your account; Comply with all applicable laws, including customs and import/export laws; Not ship, deliver, or purchase prohibited items (see Clause 9); Not harass, threaten, or abuse other Members; Only use the Platform for lawful purposes; Not use automated tools to interact with the Platform; and Cooperate with any investigation relating to transactions or compliance. 12. Specific Rules for Shippers Shippers must: Clearly describe goods and provide accurate delivery details; Not send prohibited or restricted goods; Pay all applicable fees via Trustap; Respond to Traveller queries promptly; and Confirm delivery promptly in Trustap to release funds. 13. Specific Rules for Travellers Travellers must: Deliver goods as agreed with the Shipper; If purchasing goods on behalf of the Shipper, only do so with prior agreement and proof of purchase; Not transport prohibited items; Comply with all transport, customs, and import/export regulations; and Provide proof of delivery when requested. 14. Payments All payments are processed via Trustap. Peykyar does not directly handle or hold customer funds. You agree to comply with Trustap’s payment, dispute, and refund procedures. Peykyar may charge a service commission for facilitating the transaction, collected via Trustap. Peykyar has no liability for Trustap’s own service failures, delays, or errors. 15. Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) You must not use Peykyar for: Money laundering, terrorism financing, or fraudulent transactions; Structuring transactions to avoid reporting thresholds; Transferring funds from illicit sources. Peykyar reserves the right to suspend or terminate accounts suspected of AML/CTF breaches and report them to authorities. 16. Prohibited Items You may not ship, deliver, or purchase: Firearms, ammunition, explosives; Illegal drugs, narcotics, controlled substances; Counterfeit goods or currency; Hazardous materials; Stolen property; Pornographic material; Items prohibited under Australian law or the laws of any relevant country. other items prohibited by airline, shipping, or local regulations 17. Intellectual Property All Platform content (logos, branding, design, software) is owned by Peykyar or its licensors.You may not copy, modify, distribute, or reverse engineer any part of Peykyar without written permission. 18. Third-Party Content Peykyar may display third-party content (including Trustap materials). Peykyar is not responsible for such content. 19. Privacy & Data Handling Peykyar’s Privacy Policy forms part of these Terms.We collect and store only: full name, email, phone number, and residential address. KYC documents are stored by Stripe.We may share data with authorities if legally required. 20. Disclaimer of Warranties Peykyar is provided “as is” without warranty of any kind.We do not guarantee delivery times, condition of goods, or the conduct of Members. 21. Limitation of LiabilityLiability Cap: To the maximum extent permitted by law, Peykyar’s total aggregate liability for any claim arising under or in connection with these Terms shall be limited to the total amount paid by the user for the specific service giving rise to the claim.
To the maximum extent permitted by law, Peykyar, Magnetar Technologies Pty Ltd (ACN 689 803 110), its directors, officers, employees, agents, contractors, contributors, affiliates, and licensors shall not be liable to you for any loss, damage, cost, expense, or liability of any kind, whether direct, indirect, incidental, special, consequential, exemplary, or punitive, arising out of or in connection with:(a) your use of, or inability to use, the Platform or the Services; (b) any transaction, communication, arrangement, or agreement between Shippers and Travellers, whether or not facilitated via the Platform; (c) the conduct of any Member, including fraud, misrepresentation, theft, loss, or damage to goods; (d) any unauthorised access to, or alteration of, your data; (e) any prohibited, illegal, or restricted goods shipped, purchased, or delivered using the Platform; (f) any reliance placed by you on completeness, accuracy, or existence of any advertising, content, or material on the Platform; and (g) the provision of Your Content to the Platform. Without limiting the foregoing, Peykyar’s total cumulative liability to you for any and all claims arising under or in connection with these Terms or the Services, however arising (including negligence, contract, tort, equity, statute, or otherwise), shall be limited to the lesser of: the total fees you have paid to Peykyar (if any) in the three (3) months immediately preceding the claim; or the cost of resupplying the Services. You acknowledge and agree that you use the Platform entirely at your own risk and that Peykyar makes no warranties, guarantees, or representations as to the suitability, reliability, timeliness, or accuracy of the Services. 22. Indemnity You indemnify Peykyar and its affiliates against any claims, losses, or damages arising from your use of the Platform, breach of these Terms, or violation of laws. 23. General DisclaimerAustralian Consumer Law Compliance: Peykyar complies with all requirements under the Australian Consumer Law (ACL). Nothing in these Terms is intended to exclude, restrict or modify any statutory rights or guarantees that cannot be excluded by law. Where any such statutory rights apply, they shall prevail to the extent of any inconsistency with these Terms.
Nothing in these Terms limits or excludes any guarantees, warranties, representations, or conditions implied or imposed by law, including the Australian Consumer Law, or any liability under them, which by law may not be limited or excluded. Subject to this clause, and to the extent permitted by law: All terms, guarantees, warranties, representations, or conditions which are not expressly stated in these Terms are excluded; and Peykyar, Magnetar Technologies Pty Ltd (ACN 689 803 110), its affiliates, directors, officers, employees, agents, contractors, contributors, and licensors will not be liable for any special, indirect, incidental, consequential, punitive, or exemplary loss or damage (unless such loss or damage is reasonably foreseeable as a result of Peykyar’s failure to meet an applicable Consumer Guarantee), including without limitation loss of profit, loss of opportunity, loss of business, or damage to goodwill, arising out of or in connection with the Services or these Terms, whether at common law, under contract, tort (including negligence), in equity, pursuant to statute, or otherwise. Use of the Platform, mobile application, and Services is entirely at your own risk. Everything on the Platform and within the Services is provided to you “as is” and “as available” without warranty or condition of any kind. None of Peykyar, its affiliates, directors, officers, employees, agents, contractors, contributors, or licensors make any express or implied representation or warranty about the Services or any products or services referred to on the Platform. This includes, but is not limited to, any loss or damage you may suffer as a result of:(a) failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, malicious code, or other harmful component; (b) loss of data, communication line failure, unlawful third-party conduct, or unauthorised access to records; (c) the accuracy, completeness, suitability, legality, or currency of any information on the Platform, the Services, or related products (including third-party material and advertisements); (d) costs incurred as a result of your use of the Platform, the Services, or any products of Peykyar;(e) the Services or operation in respect to any links provided for your convenience; (f) any financial, investment, or business decision made in reliance on information or materials provided via the Platform or Services; and (g) the conduct of any Member, including fraud, misrepresentation, loss, theft, or damage to goods. You acknowledge that the Platform and Services are solely intended to facilitate interactions and transactions between Shippers and Travellers and do not offer, perform, or guarantee the transport, purchase, or delivery of goods. Peykyar holds no liability to you as a result of the conduct of Members, or the misuse of Your Content by any party (including other Members). 24. Copyright and Intellectual Property The Platform, the Services, and all related products of Peykyar are protected by copyright under the laws of Australia and international treaties. Unless otherwise indicated, all rights (including copyright) in the Services and compilation of the Platform (including but not limited to text, graphics, logos, button icons, videos, audio clips, Application code, scripts, design elements, and interactive features) are owned or controlled by Magnetar Technologies Pty Ltd (ACN 689 803 110) or its contributors, and are reserved. All trademarks, service marks, and trade names appearing on the Platform are owned, registered, and/or licensed by Peykyar, which grants you a worldwide, non-exclusive, royalty-free, revocable licence while you are a Member to: Use the Platform and Services pursuant to these Terms; Copy and store the Platform and the material contained in the Platform in your device’s cache memory; and Print pages from the Platform for your own personal and non-commercial use. You may only use the Platform and Services for lawful purposes and in accordance with these Terms. Except as expressly stated above, no other rights whatsoever are granted to you in relation to the Platform or the Services. All other rights are expressly reserved by Peykyar. Peykyar retains all rights, title, and interest in and to the Platform and all related Services. Nothing you do on or in relation to the Platform will transfer to you any: Business name, trading name, domain name, trademark, industrial design, patent, registered design, or copyright; Right to use or exploit a business name, trading name, domain name, trademark, or industrial design; or Thing, system, or process that is the subject of a patent, registered design, or copyright (or an adaptation or modification of such). You must not, without the prior written consent of Peykyar and the consent of any other relevant rights owner: broadcast, republish, upload to a third party, transmit, post, distribute, show or play in public, adapt, or change in any way the Services or third-party content for any purpose, unless otherwise permitted by these Terms. This prohibition does not apply to materials on the Platform that are expressly stated to be freely available for re-use or are in the public domain. Where you broadcast, publish, upload, transmit, post, or distribute Your Content on the Platform, you grant to Peykyar a non-exclusive, transferable, perpetual, royalty-free, irrevocable, worldwide licence to broadcast, republish, upload to a third party, transmit, post, distribute, show or play in public, adapt, or change Your Content for the purposes of providing the Services and operating the Platform. 25. Dispute Resolution Disputes relating to transactions must be raised in Trustap first. If unresolved, the parties may escalate via mediation in NSW, Australia. 26. Termination Peykyar may suspend or terminate your account if you breach these Terms, violate laws, or engage in fraudulent activity. 27. Competitors If you are directly or indirectly engaged in, employed by, advising, or otherwise associated with a business or entity that provides delivery coordination, courier matching, peer-to-peer shipping, or any substantially similar services to those offered by Peykyar, whether for commercial gain or otherwise, you are deemed a competitor of Peykyar. Competitors are strictly prohibited from registering, accessing, or using the Platform, or from obtaining, reproducing, distributing, modifying, reverse-engineering, or otherwise utilising any information, content, trade secrets, intellectual property, or data from the Platform for any purpose. Any breach of this clause will constitute unauthorised access and a material violation of these Terms. Peykyar reserves the right to:(a) immediately suspend or terminate your access without notice; (b) pursue injunctive relief, damages, and any other remedies available at law or in equity; and (c) require you to account for and pay to Peykyar all profits, benefits, and advantages derived from the breach, together with any legal costs on an indemnity basis. 28. Relationship of the Parties You acknowledge and agree that your use of the Peykyar Platform (whether as a Shipper or Traveller) does not create any relationship of: Employer and employee; Principal and agent; Partnership; Joint venture; or Contractor/subcontractor between you and Peykyar (Magnetar Technologies Pty Ltd, ACN 689 803 110). Peykyar acts solely as a technology platform provider facilitating the connection, communication, and payment process between Shippers and Travellers. Peykyar does not employ, manage, control, or supervise any Traveller or Shipper, nor does it guarantee the quality, safety, legality, or completion of any delivery arranged through the Platform. You further agree that: You are solely responsible for all activities you undertake through the Platform; You act on your own behalf and not on behalf of Peykyar; Any agreements you enter into with other users are solely between you and that user, and Peykyar is not a party to those agreements; and Peykyar has no obligation to provide employment benefits, insurance, leave entitlements, or any other rights typically associated with an employment or contractor relationship. Nothing in these Terms is intended to create, or may be construed as creating, any such relationship between you and Peykyar. 29. Governing Law The Terms are governed by the laws of New South Wales, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of New South Wales, Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. The Terms shall be binding to the benefit of the parties hereto and their successors and assigns. 30. Dispute Evidence Support All transaction-related disputes between Shippers and Travellers must be lodged and resolved through Trustap in accordance with its Terms of Service. Where a dispute is raised, Trustap may request supporting evidence from either party. By using the Platform, you authorise Peykyar to: Provide Trustap with any relevant records or data in Peykyar’s possession that may assist in resolving the dispute, including (but not limited to) communication logs, transaction records, shipment details, and profile information; Disclose such information in compliance with applicable privacy laws; and Cooperate with Trustap’s dispute resolution process as a neutral third party. Peykyar does not make the final decision in any dispute and is not responsible for the outcome. The final determination of the dispute rests solely with Trustap in accordance with its own policies and procedures. 31. Updates to Terms Peykyar may update these Terms at any time. REFUND AND CANCELLATION POLICY In addition to the clauses above, the following applies to refunds and cancellations: - Shipper-initiated cancellation before delivery: Funds held in Trustap’s escrow will be returned to the Shipper within 1–2 business days, subject to Trustap’s refund process and timelines. - Traveller-initiated cancellation: If a delivery cannot be completed for reasons not caused by the Traveller, any unpaid amounts will not be charged. Amounts held in escrow will be released in accordance with Trustap’s policies. - Platform cancellations: Peykyar may cancel a transaction for fraud risk, prohibited items, or policy breaches. In such cases, funds will follow Trustap’s refund procedures. - All cancellations and refund requests must be made through the Platform to ensure proper tracking and dispute handling. 34. PROHIBITED ITEMS & CUSTOMS COMPLIANCE POLICY This section supplements the “Prohibited Items” clause: - Users must ensure the legality of items under the laws of both origin and destination, including airline, aviation security, and border force rules. - Items restricted or requiring permits (e.g., medications, electronics with lithium batteries, food, cosmetics) must comply with applicable import/export controls. - Users are solely responsible for customs duties, taxes, declarations, and penalties associated with their items. - Peykyar may require proof of compliance (e.g., receipts, declarations) and may suspend or terminate transactions that pose legal or safety risks. 35. USER CODE OF CONDUCT All Members agree to: - Communicate respectfully and refrain from harassment, discrimination, or abusive language. - Provide accurate information about items, delivery timelines, and identities. - Respond promptly to messages and reasonable requests for evidence in the event of a dispute. - Follow all applicable laws and transport rules, including airline and customs regulations. - Refrain from using bots, scrapers, or automated tools. Breaches of this Code may result in warnings, suspension, or permanent removal from the Platform. 36. KYC & VERIFICATION POLICY - KYC is performed by Stripe, Inc. Peykyar does not store identity documents and retains only basic profile data necessary to operate accounts (full name, email, phone, residential address). - If KYC cannot be completed or is failed, Peykyar may restrict features, freeze transactions in escrow, or suspend the account until completion. - Peykyar may request re-verification at any time where fraud, risk, or regulatory obligations require it. 37. COOKIE POLICY - The Platform uses cookies and similar technologies for essential functionality, security, and analytics. - Where required by law, users will see a consent notice on first visit and may opt out of non-essential cookies. Disabling cookies may affect Platform functionality. 38. DATA BREACH RESPONSE If Peykyar becomes aware of a data breach likely to cause serious harm, Peykyar will take reasonable steps to: - Contain and assess the breach; - Notify affected users as soon as practicable with details of the incident and recommended steps; and - Cooperate with relevant authorities in accordance with applicable laws. 39. INTERNATIONAL USE & LOCAL LAWS - Although these Terms are governed by the laws of New South Wales, Australia, users must also comply with the local laws of any country in which they access or use the Platform and through which goods are transported. - Where local consumer law provides non-excludable rights, nothing in these Terms limits those rights.
