These terms and conditions govern the use of the Planeta Guru platform (hereinafter, the "Platform"). By accessing and using the Platform, you accept these terms and conditions, so we recommend reading them carefully. If you do not agree with the terms, we kindly ask that you refrain from using this site.
1. Definitions
Platform: The online service available at https://planeta.guru/, which offers digital content and products to users.
Planeta Guru: ITBAF, S.A. DE C.V.
User: Any person who accesses, uses, or registers on the platform.
GURUs: Virtual currency or reward points that users can purchase, accumulate, and exchange for use on the platform.
Planeta Guru+: The premium subscription tier that grants access to exclusive content and special benefits.
Digital products: Any computer content, games, applications, and intangible goods available on the platform.
Subscription: Defined as the periodic and recurring access scheme subject to a periodic fee.
Official channels: Defined as the interfaces and web portals directly administered by ITBAF, S.A. DE C.V.
2. Acceptance of the Terms
Access to and use of the Platform constitutes full acceptance of these terms and conditions. If you do not agree with any of the provisions, you must refrain from using the Platform. Use of the Platform constitutes express acceptance of the terms and conditions, as well as of any modifications that may be made thereto.
3. Service Availability and Geographic Limitation
The Planeta Guru Platform (https://planeta.guru/) is intended for users located in specific geographic areas; accordingly, this site and the services offered may not be available in all locations, and we reserve the right to restrict access to this site at any time and at our sole discretion.
The user is responsible for ensuring that use of the site and its services is legal in the territory from which they intend to access the Platform.
The use of tools such as VPNs or proxies to access the service from outside these areas is expressly prohibited. In the event of any discrepancy between versions of these terms and conditions in different languages, the Spanish version shall prevail.
The Platform will be available at all times only for the territories it designates; however, access to the site may be interrupted or temporarily suspended at any time, without any liability that users may claim.
All Users are required to disclose their place of residence. By accepting the Terms and Conditions, the user authorizes the Platform to use the necessary tools to detect the network device's location with respect to the country of origin from which the account registration and corresponding subscription were made.
4. Management of Personal Data and Privacy
Planeta Guru complies with applicable personal data protection regulations, in accordance with the personal data protection laws in force for the country from which the site is accessed.
The personal data we collect will be processed in accordance with our Privacy Policy, which describes the data that will be collected, how it will be used, and the rights related to this information, as well as the exercise of the rights of access, rectification, cancellation, and objection ("ARCO", per the Spanish acronym) granted to each user.
The user agrees that, by accessing the Platform, they accept the processing of their personal data in accordance with the Privacy Policy.
5. Responsibility for Purchased Products
The user is responsible for ensuring that their device meets the technical requirements necessary to use the products or services offered through the Platform. The technical specification sheet for each product will specify these requirements. Planeta Guru does not guarantee the continuous, uninterrupted availability of the service and is not responsible for any technical failures or interruptions that may occur.
Once a product has been purchased, no returns or refunds will be accepted, except where there are defects in the file or in the digital content provided due to causes attributable to Planeta Guru, which shall have the exclusive authority to determine whether the product is actually defective or not.
Planeta Guru does not guarantee the continuous, error-free availability of the digital products offered.
Planeta Guru will not be liable for any indirect, incidental, or consequential damages arising from the use of and/or access to the platform, or from the inability to use it.
6. Registration and Subscription to Planeta Guru

User Registration: To access the services provided through the Platform, the user must register and create an account. During the process of registering required data, such as their username, email address, and a password, the user will be asked to provide this information and ensure it meets the security standards (minimum of 8 characters, including uppercase letters, lowercase letters, and numbers). The user may optionally provide a phone number.
The user shall be responsible for providing truthful, up-to-date, and complete information, as well as for maintaining the confidentiality of their credentials.

The platform and the services and products offered through it are intended for persons who have the legal capacity to enter into contracts under the laws of their country of residence. Use of the Platform by minors is conditional upon their having prior, express authorization and being under the direct supervision of their parents, guardians, or legal representatives.
Parents, guardians, or legal representatives shall be solely and fully responsible for the acts that minors under their care carry out on the Platform, including, without limitation: registering the account, accepting these Terms and Conditions, browsing, interacting with content, and any transaction, purchase of GURU packs, or subscriptions made within the Platform using the GURU Wallet.
Planeta Guru reserves the right to implement any verification mechanisms it deems appropriate at any time. If Planeta Guru detects or has reasonable grounds to suspect that an account is being used by a minor without the proper authorization or supervision of their parents or guardians, it may suspend, restrict, or cancel such account immediately, without any liability whatsoever and without any right to a refund for the User.

Access Without Registration: Unregistered users may browse the platform's catalog. However, in order to enjoy the additional services and features of Planeta Guru, creating an account under the terms of the preceding paragraph will be required.

GURU Wallet: Upon completing the registration process, users will gain access to the "My GURU Wallet" feature, from which they can manage their transactions, including the activation, renewal, or cancellation of their Planeta Guru+ subscription, the purchase of GURU packs through authorized payment platforms, and the acquisition of games and other products.

Acceptance of Terms and Conditions: To complete registration and/or subscription, the user must accept the Platform's Terms and Conditions, the Privacy Policy, and any other applicable legal document. Subscription via a mobile line implies additional acceptance of the specific terms and conditions of the corresponding carrier.

Account Restriction: Planeta Guru reserves the right to deny, suspend, or cancel the registration and/or subscription of any user who fails to provide the required information or who may pose a potential risk of harm to the Platform or third parties.
7. Personal Use and Prohibition of Resale

The products and services offered on the platform are intended solely for personal use, and their resale, distribution, or any commercial use is strictly prohibited.
Any attempt at unauthorized resale, distribution, or transfer may result in the suspension or cancellation of the user's account without right to a refund; the user will also be subject to any applicable legal consequences.

Disclaimer of Liability: Planeta Guru is not responsible for the purchase of products outside of official distribution channels. We do not guarantee the authenticity, originality, quality, or safety of products acquired through independent resellers, unauthorized third-party e-commerce platforms (marketplaces), social media, or any other informal channel.

Loss of Warranty and Support: Any manufacturer's warranty, return policy, exchange, or customer service offered by Planeta Guru will be automatically voided if the product was purchased outside our official sales channels. The buyer assumes all risk and responsibility when transacting with unauthorized third parties.
8. Exchange and Refund Policy
The user has the right to request exchanges or refunds in accordance with applicable consumer protection laws, depending on their jurisdiction. Planeta Guru reserves the right to offer refunds only in GURUs, unless otherwise indicated for the specific product.
9. Prohibited Uses and System Security
The User is strictly prohibited from carrying out or attempting any act that affects the security or the proper functioning of the Platform. Without limitation, the following are prohibited: the use of bots, scripts, or automated tools; scraping techniques or mass data extraction; hacking, reverse engineering, or alteration of the platform's code; as well as the manipulation of results, the use of exploits, cheats, or any form of fraud in the games or in the GURU Wallet.
Any violation of this section shall entitle Planeta Guru to suspend or cancel the User's account immediately and permanently, block their access, rescind their GURUs and products without right to a refund, and pursue any applicable civil or criminal legal action.
10. Validity and Use of GURUS
Accumulated GURUs have limited validity, based on the conditions specified on the platform; GURUs are non-transferable.
If the user's account is deleted, all GURUs will be permanently lost, unless the reason for deletion is related to a technical failure attributable to Planeta Guru.
11. Dispute Resolution
In the event of disputes arising from the use of the Platform or the interpretation of these terms and conditions of use, the user and Planeta Guru agree to attempt to resolve them amicably.
If no agreement is reached, the parties will submit to the competent courts of Mexico City, unless the applicable law in the country from which the Platform is accessed provides otherwise.
12. Platform Security
The user is responsible for maintaining the confidentiality of their account and password. Planeta Guru recommends the use of strong passwords and their periodic renewal. Planeta Guru will not be liable for unauthorized access resulting from the user's negligence in securing their account.
13. Modifications to the Terms and Conditions
Planeta Guru reserves the right to modify these terms and conditions at any time. Modifications will be notified to users with a reasonable period of notice before they take effect. Continued use of the Platform after notification of the new terms constitutes acceptance by the user.
14. Limitation of Liability
Planeta Guru and its licensors will not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the platform, including, but not limited to, loss of data, loss of profits, or interruption of service.
15. Applicable Law
These terms and conditions shall be governed by and construed in accordance with applicable law and the jurisdiction of the competent courts of Mexico City, without prejudice to applicable conflict-of-law rules.

By using the Platform, the user acknowledges having read, understood, and accepted these terms and conditions in their entirety. The user also agrees that continued use of the Platform's services constitutes express agreement with any update or modification made to these terms and conditions. It is the user's responsibility to periodically review these terms and conditions to stay informed of any changes. If the user does not agree with any provision hereof, they must immediately discontinue use of the Platform.
