BY ENTERING INTO A CONTRACT and or JOB AGREEMENT, WRITTEN and or VERBAL WITH CMHI, THE CLIENT, AGENT OR REPRESENTITIVE ACKNOWLEDGES and AGREES THAT THEY HAVE DONE THEIR OWN DUE DILIGENCE AND HAVE READ, UNDERSTAND, AND AGREE TO ALL TERMS AND CONDITIONS HEREWITHIN MADE READILY AVAILABLE TO THE PUBLIC.
Whether it be by the signing or verbal agreement for service with a CMHI Job Contract or the giving and receiving of payment from Client, Agent and or Client Representative to Inspector/CMHI for agreed services, the Client acknowledges and agrees to all terms, conditions, agreement and disclaimers of InterNACHI and CMHI.
We have made every attempt to make public this information for our clients knowledge through either our website, Facebook, emails, verbally, written and or otherwise and encourage your due diligence in asking questions prior to entering into an agreement.
TERMS;
AGREEMENT: An Agreement is made between;

THE CLIENT: Being the name and address as listed on the CMHI Job Contract. being the name, address, phone and or email and contact information listed on the job contract hereafter referred to as \"Client\".
CMHI JOB CONTRACT: The contract provided by CMHI that includes the inspection place address, Client’s name, address and contact information, the Clients inspection needs, options and quoted price and agreement information whether in writing or verbally agreed. It is understood that all Clients have viewed this “CMHI - TERMS, CONDITIONS, AGREEMENT and
DISCLAIMER” prior to signing or other form of verbal / written acceptance of service by CMHI Job Contract, this being considered the Clientsresponsibility. By the signing or other form of verbal and or written acceptance of service of the CMHI Job Contract, the Client is bound and trusted that they have in fact, read, understood and accept this agreement. This contract becomes active and enforceable upon the signing; in person, digitally, and or verbally agreed upon in all normal and excepted manner of this type of business transaction to include the payment for services rendered prior to service.
PROPERTY TO BE INSPECTED: As listed on the CMHI Job Contract.
FEE: As outlined on the CMHI Job Contract.
[Inspection Fee] Due in full prior to the start of the inspection for the amount as listed on the CMHI Job Contract.
1. SCOPE OF INSPECTION AND LIMITATIONS
The Inspector agrees to perform a visual, non-invasive inspection of the readily accessible systems and components of the property, in accordance with the current InterNACHI Standards of Practice (available online). The purpose of the inspection is to identify material defects that are visible at the time of the inspection \"only\". Following InterNACHI protocol and Maine State Law.
THE INSPECTION IS NOT:
A Warranty or Guarantee: The inspection and report are not a guarantee or warranty regarding the future life, performance, or condition of the property, its systems, or components.
Technically Exhaustive: The inspector will not dismantle equipment, move furniture, personal items, or fastened surfaces to expose concealed conditions.
Code Compliance: The inspection will not determine compliance with any building codes, regulations, or ordinances.
Environmental/Hazardous Materials: The standard inspection will not test for or identify the presence or absence of environmental hazards, including, but not limited to, mold, mildew, radon, asbestos, lead paint, toxic wastes, or termite/pest infestation.
2. DISCLAIMER OF WARRANTIES
THE INSPECTOR MAKES NO WARRANTIES; EXPRESS OR IMPLIED, AND ANY SUCH WARRANTY IS SPECIFICALLY EXCLUDED AND DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY MAINE LAW. The property is being inspected and reported on \"AS IS\" at the time of the inspection “ONLY”. The Inspector is not an insurer of the property's condition. The inspector is not responsible for hidden problems, issues and / or workability due to intentional, unintentional or seasonal inaccessibility due to the lack of the home’s functionality, heating, electrical or other abilities of the home to be in full running and workable order, available and visible at the time of the inspection. Variables that may develop or arise after the active inspection is completed are “not” the responsibility of the inspector.
3. LIMITATION OF LIABILITY
Client understands and agrees that the Inspector and its employees/agents are limited in liability to an amount no greater than the fee paid for the inspection services and / or “add on” portion fee and report. The Client waives any claim for repair, consequential, exemplary, special, or incidental damages, or for the loss of the use of the home.
The Client understands and agrees that the inspection is not a warranty or guarantee against future defects. The Client agrees to hold the inspector harmless for purchase decisions and hidden issues. The Client agrees and acknowledges that the inspection report is meant to be an informational tool and does not constitute a recommendation to purchase or not purchase the property. The inspector is not responsible for the Clients decision regarding the transaction. The Client takes sole responsibility for all decisions concerning the purchase of the property.
4. SOLE AND EXCLUSIVE USE
The inspection and report are for the sole and exclusive use of the Client. No other person or entity (e.g., real estate agents, sellers, and insurance companies, or public posting, may rely on the report without the express written consent of the Inspector. Client agrees to indemnify and hold harmless the Inspector from any claims brought by third parties who receive or rely on the report.
5. CLAIMS AND DISPUTE RESOLUTION
Any claim for failure to accurately report visually discernible conditions must be made in writing and reported to the Inspector within ten (10) business days of discovery and are void after 90 days from service. The Client agrees to allow the Inspector the right to re-inspect the claimed discrepancy before any alterations, modifications, or repairs are made. Failure to comply with this notice provision shall constitute a waiver of any claim. Any dispute arising from this agreement shall be submitted to binding arbitration in accordance with industry standards.
6. ENTIRE AGREEMENT & MAINE AG WARNING
This written Agreement in conjunction with InterNACHI Standards and Protocols represents the entire agreement between the parties. No oral agreements, promises, or representations shall be binding.
7. OPTIONAL INSPECTION LIMITATIONS
Some limited optional inspections are available by CMHI and priced separately. These inspections may reveal areas of concern “only” as an informational tool. It is then recommended that you hire a specific qualified professional for a more comprehensive investigation of the identified issue(s) before proceeding further. Optional Inspection concerns are not the responsibility of the inspector to resolve or council.
MAINE HOME INSPECTORS: Maine does not license or regulate home inspection contractors. When hiring a contractor, we recommend you seek referrals from trusted sources and check references. The Client is strongly advised to visit the Attorney General’s publicly accessible website to gather current information on how to enforce their rights when constructing or repairing their homes, as well as the Attorney General’s publicly accessible website.
