Can You Sue a Funeral Home for Emotional Distress in Michigan?
Yes. Under certain circumstances, you may sue a funeral home for emotional distress in Michigan. Funeral homes are entrusted with the respectful care, preparation, transportation, viewing, burial, and cremation of a deceased person. When a funeral home negligently or intentionally violates that trust, the deceased person’s surviving family members may have the right to pursue compensation.
Michigan law has long recognized that the mishandling of human remains is different from an ordinary negligence case. The emotional harm caused by seeing or learning that a loved one’s body was mistreated, misplaced, damaged, improperly prepared, wrongfully cremated, or improperly buried can be severe and lasting.
When Can a Funeral Home Be Sued in Michigan?
A funeral home may potentially be held responsible when its employees or contractors fail to handle a deceased person’s remains with reasonable care and dignity. Actionable conduct may include losing or misidentifying a body, presenting the wrong body at a viewing, improperly embalming or storing remains, allowing a body to decompose, damaging a casket or remains, performing an unauthorized cremation, burying the wrong person, placing remains in the wrong grave, withholding remains from the family, or otherwise interfering with the family’s burial and disposition rights.
A lawsuit may also arise when a funeral home makes material promises regarding the preparation, transportation, viewing, burial, or cremation of a loved one and fails to perform those promises. Depending on the facts, the family may have claims based on negligence, mishandling of a corpse, interference with the right of burial, breach of contract, fraud, misrepresentation, or intentional infliction of emotional distress.
Michigan Recognizes Claims for Mishandling Human Remains
Michigan courts recognize a cause of action against a person or business that intentionally, recklessly, or negligently removes, withholds, mutilates, mistreats, or improperly handles a deceased person’s body, or prevents its proper burial or cremation. The claim generally belongs to the family member who had the legal right to control the disposition of the deceased person’s remains.
The Michigan Court of Appeals has explained that damages for improperly treating a corpse may be measured by the mental anguish or humiliation suffered by family members who were deprived of the comfort of knowing that their loved one received a dignified resting place. Unlike an ordinary negligent-infliction-of-emotional-distress claim, a mishandling-of-remains claim may permit recovery for emotional distress without requiring proof of a separate physical injury.
Is Physical Injury Required?
Not necessarily. In many ordinary Michigan negligence cases, emotional distress by itself may not be sufficient unless the distress produces objective physical consequences or another independent basis for liability exists. Michigan courts, however, have historically treated the negligent mishandling of a deceased person’s body as a special category.
When the case is properly brought as a claim for mishandling a corpse or interference with burial rights, the surviving family member may not be required to prove a physical injury. The emotional anguish caused by the wrongful treatment of the remains may itself be compensable.
The exact legal theory matters. A general claim labeled only “negligent infliction of emotional distress” may be subject to requirements involving physical harm, immediate-family status, and contemporaneous observation of the negligent event. A properly pleaded mishandling-of-remains claim is legally distinct and may not require those same elements.
What Must the Family Prove?
The required proof depends on the claims asserted, but a family will generally need evidence showing that the funeral home had responsibility for the deceased person’s remains, that it mishandled the remains or interfered with the family’s burial rights, and that the wrongful conduct caused emotional anguish or other damages.
The family must also establish that the person bringing the claim had the legal right to possess, control, bury, cremate, or otherwise direct the disposition of the deceased person’s remains. Merely experiencing sadness or grief from the death itself is not enough. The lawsuit must connect the additional emotional trauma to the funeral home’s wrongful conduct.
A funeral home is not automatically responsible simply because an upsetting event occurred. There must be evidence tying the funeral home or its agents to the improper handling, withholding, mutilation, misidentification, storage, transportation, preparation, burial, or cremation of the remains.
Examples of Funeral-Home Negligence
Funeral-home negligence may include presenting a visibly decomposed or improperly prepared body to the family, placing the wrong person in a casket, losing cremated remains, mixing one person’s ashes with another person’s ashes, cremating a body without authorization, embalming against the family’s instructions, failing to refrigerate or preserve the body properly, dropping or damaging a casket, hiding a mistake from the family, or refusing to release remains without lawful justification.
Other cases may involve a funeral home promising a particular service and then failing to provide it, altering documents, misrepresenting what occurred, charging for services that were never performed, or attempting to conceal damage to the body or casket.
What Damages May Be Recovered?
The damages available in a Michigan funeral-home lawsuit depend on the facts, the legal claims, and the evidence. Recoverable damages may include compensation for mental anguish, humiliation, shock, anxiety, loss of sleep, depression, psychological trauma, physical symptoms caused by the distress, counseling expenses, medical expenses, and the cost of corrective funeral, burial, or cremation services.
The family may also seek reimbursement for amounts paid for services that were not properly performed. In an appropriate case, damages may be available for breach of contract, fraud, or intentional misconduct. Exemplary damages may also be considered where the defendant’s malicious, willful, wanton, or reckless conduct caused humiliation, outrage, or injury to the family’s feelings.
There is no automatic or guaranteed settlement amount. The value of a case depends on the seriousness of the misconduct, the condition of the remains, whether the family personally witnessed the incident, whether the funeral home attempted to conceal the mistake, the duration of the emotional suffering, and the quality of the available evidence.
What Evidence Should Be Preserved?
Families should preserve all funeral contracts, receipts, invoices, burial permits, cremation authorizations, photographs, videos, text messages, emails, voicemail messages, and written communications with the funeral home. The names of employees, witnesses, clergy members, cemetery workers, transport personnel, and other people who observed what happened should also be documented.
Family members should write down a detailed timeline while the events remain fresh in their memories. Records from therapists, counselors, doctors, or other healthcare providers may help demonstrate the nature and extent of the emotional trauma.
Do not surrender original photographs, videos, contracts, or other important evidence to the funeral home. Copies may be provided when appropriate, but the originals should be preserved in a safe location.
How Long Do You Have to File a Lawsuit?
Michigan lawsuits are governed by statutes of limitation. The filing deadline may depend on whether the case is characterized as ordinary negligence, mishandling of remains, professional malpractice, breach of contract, fraud, or another cause of action.
Michigan authority has treated mishandling-of-remains claims as traditional common-law tort claims, but limitation statutes have been amended over time and the correct deadline must be evaluated under the current law and the specific facts of the case.
Waiting can result in the loss of surveillance footage, records, employee testimony, photographs, and other important evidence. A family should therefore speak with a Michigan funeral-home negligence attorney as soon as possible after discovering the misconduct.
Can You Sue if You Did Not See the Mishandling Occur?
Possibly. A family member does not always have to personally witness the funeral home’s negligent act to bring a claim for mishandling human remains. A family may discover the misconduct later through photographs, admissions, records, a second funeral home, cemetery workers, exhumation, or the condition of the body during a viewing.
However, personal observation and contemporaneous shock may become important when the claim is pleaded as negligent infliction of emotional distress rather than as the separate tort of mishandling a corpse. The correct legal theory should be determined based on precisely what occurred and how the family learned about it.
Who May Bring the Lawsuit?
The person with the legal right to control the disposition of the deceased person’s remains will ordinarily have the strongest basis for a mishandling claim. Depending on the circumstances, this may include a surviving spouse, adult child, parent, personal representative, or another person authorized under Michigan law.
Not every relative or person who experiences grief will automatically have an individual claim. The relationship to the deceased, the right to control disposition, the person’s involvement in the funeral arrangements, and the nature of the emotional harm must all be evaluated.
