When a funeral home or cemetery fails to honor a loved one with the dignity, respect, and care every family deserves, the emotional pain can be overwhelming. Families place enormous trust in funeral directors, crematories, and cemeteries during one of the most difficult moments of their lives. When that trust is violated through negligence, carelessness, or misconduct, Michigan law may provide the right to seek compensation. At Advanta Law, we are committed to holding funeral homes, cemeteries, and cremation providers accountable when their actions cause unnecessary emotional suffering.
Funeral Home Negligence
Funeral homes have a legal and professional duty to properly care for the deceased and to carry out a family's wishes with dignity and respect. When funeral providers fail to meet these obligations, surviving family members may have legal claims for negligence, breach of contract, emotional distress, or other damages. Our attorneys investigate every aspect of the funeral home's conduct to determine whether legal action is appropriate.
Mishandling or Desecration of Human Remains
Nothing is more disturbing than discovering that a loved one's remains were mishandled or treated disrespectfully. Mishandling may include improper transportation, damage to remains, failure to preserve the body, unauthorized handling, or any conduct that desecrates human remains. Such conduct may give rise to substantial legal claims for emotional distress and other damages.
Wrongful Cremation
Families have the right to expect that the remains returned to them belong to their loved one. Wrongful cremation cases may involve cremating the wrong individual, performing a cremation without proper authorization, or failing to follow the family's instructions. These tragic mistakes often cause lifelong emotional trauma and may justify significant legal recovery.
Burial in the Wrong Grave
Burial errors can occur when cemetery personnel bury a loved one in the wrong burial space or mistakenly place another individual in a reserved grave. These mistakes frequently require exhumation, reburial, and create devastating emotional consequences for surviving family members. Our attorneys aggressively pursue claims arising from wrongful burials and cemetery errors.
Casket or Vault Failures
A cemetery has a responsibility to perform interments properly and in accordance with accepted industry standards. Improper installation of burial vaults, defective vaults, collapsing graves, or caskets becoming exposed may indicate negligence by the cemetery or other responsible parties. We work with qualified experts to determine the cause of these failures and pursue appropriate legal remedies.
Cemetery Negligence
Cemeteries owe families a duty to properly maintain burial grounds, preserve grave sites, accurately identify burial locations, and conduct burials safely. Negligence may include improper maintenance, grave damage, unauthorized disturbance of graves, incorrect recordkeeping, improper interment procedures, or failure to protect burial sites from foreseeable harm.
Grave Collapse
A grave that collapses, sinks, or allows a casket or burial vault to become exposed is often the result of improper burial practices, inadequate soil preparation, poor maintenance, defective vault installation, or other negligent conduct. These incidents can be emotionally devastating and may support claims against the responsible cemetery or funeral provider.
Improper Exhumation
Removing human remains without proper authorization or contrary to legal requirements can violate both the law and the dignity owed to the deceased. Families affected by unauthorized or negligent exhumation may have substantial legal claims depending upon the circumstances.
Loss or Mixing of Cremated Remains
Families trust crematories to carefully identify, preserve, and return the correct cremated remains. Losing, mixing, or misidentifying cremated remains represents one of the most serious breaches of that trust. These cases often involve significant emotional harm and deserve careful legal investigation.
Funeral Home Fraud and Breach of Contract
Funeral homes and cemeteries are expected to honor the agreements they make with grieving families. Fraudulent billing, selling services that were never provided, misrepresenting burial products, failing to perform contracted services, or violating prepaid funeral agreements may constitute fraud, breach of contract, or violations of Michigan law.
Emotional Distress Caused by Funeral or Cemetery Misconduct
Many funeral and cemetery negligence cases involve severe emotional distress suffered by surviving family members. Discovering that a loved one's remains were mishandled, improperly buried, wrongfully cremated, or otherwise disrespected can leave lasting emotional scars. Michigan law may permit recovery of damages depending upon the specific facts and circumstances of the case.
