1. Introduction

These terms and conditions apply to the Mepic app (hereinafter referred to as "Application") for mobile devices and web browsers that was created by Totain Ltd (hereinafter referred to as "Service Provider") as a Free service.

2. Acceptance of Terms

By downloading, accessing, or using the Application, you expressly acknowledge and agree that you are entering into a legal agreement with the Service Provider, and have understood and agree to comply with, and be legally bound by, these Terms & Conditions. You hereby waive any applicable rights to require an original (non-electronic) signature or delivery or retention of non-electronic records, to the extent not prohibited under applicable law.

3. Content Rights and Ownership

All content accessible through the Application, including but not limited to text, graphics, images, audio, and video (collectively referred to as "Content"), whether pre-existing or newly created using the Application's features, is owned by, licensed to, or controlled by the Service Provider.

Given the evolving legal landscape regarding AI-generated content, you acknowledge and agree that:

The Content is generated by artificial intelligence (AI) models based on user inputs.
The Service Provider claims, to the fullest extent permitted by applicable law, all intellectual property rights and other proprietary rights in the Content.
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Content solely for your personal, non-commercial use through the Application.
You shall not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, or otherwise exploit the Content except as expressly permitted in these Terms.

4. Content Disclaimer and User Responsibility

You acknowledge and agree that:

The Content generated through the Application is created by AI models and may vary in quality, accuracy, and appropriateness.
You are solely responsible for the inputs you provide to generate Content.
The Service Provider is not responsible for any Content generated based on user inputs, nor for any consequences resulting from the use or viewing of such Content.
The Service Provider reserves the right to monitor, edit, or remove any Content that it determines, in its sole discretion, to be inappropriate or in violation of these Terms.

5. Data Protection and Device Security

The Application stores and processes personal data that you have provided to the Service Provider. It is your responsibility to maintain the security of your device (whether it's a mobile phone or a computer running the browser version of Mepic) and access to the Application. This includes keeping your device's operating system and security software up to date, using strong passwords, and not sharing your account information.

The Service Provider is committed to protecting your personal information and takes reasonable measures to ensure its security. We use industry-standard security practices, including:

Storing personal identifiable information (PII) on Firebase, which provides built-in security features such as encryption at rest and secure data transmission.
Using HTTPS for all data transmission, ensuring that all data is encrypted in transit.
Never storing sensitive data in plain text.

However, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

To the maximum extent permitted by applicable law, in no event shall the Service Provider be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the Application.

8. Updates and Termination

The Service Provider reserves the right to modify, update, or discontinue the Application or any of its services at any time and for any reason, with or without notice to you. We may also charge for certain services or features in the future, but we will always clearly communicate any pricing changes to you before they take effect.

You agree to always accept updates to the Application when offered. We may also wish to stop providing the Application, and may terminate use of it at any time without giving notice of termination to you.

Upon any termination: (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the Application, and (if needed) delete it from your device.

9. Changes to These Terms

The Service Provider reserves the right to modify these Terms & Conditions at any time. We will notify you of any changes by posting the new Terms & Conditions on this page and updating the "Last updated" date at the bottom of this page. Your continued use of the Application after any such changes constitutes your acceptance of the new Terms & Conditions.

10. Dispute Resolution

Any dispute arising from or relating to the subject of this Agreement shall be governed by the laws of England and Wales, without regard to its conflict of laws provisions. Any legal action or proceeding relating to this Agreement shall be instituted in the courts of England and Wales. You and the Service Provider agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.
