Kitchen v. Herbert, 961 F.Supp.2d 1181 (D. Utah 2013), affirmed, 755 F.3d 1193 (10th Cir.

2014); stay granted, 134 S.Ct. 893 (2014); petition for certiorari denied, No. 14-124, 2014 WL 3841263 (Oct.

6, 2014), is the federal case that successfully challenged Utah's constitutional ban on marriage for same-sex couples and similar statutes. Three same-sex couples filed suit in March 2013, naming. Several Utah residents and same-sex couples applied for marriage licenses in Utah and were denied.

They filed suit against the Governor, the Attorney General of Utah and the Clerk of Sale Lake County, all in their official capacities, challenging provisions of Utah law relating to same-sex marriage. Utah Code 30-1-2(5) included among the marriages that were "prohibited and declared void. The State of Utah appealed that decision to the United States Court of Appeals for the Tenth Circuit.
