This privacy policy explains what information Secure Internet Solutions LLC, a Tennessee limited liability company, d/b/a Watch Our Own ("Watch Our Own", "we", "our" or "us") collects and saves from you when you use our website, applications and services (the "Services"). By using the Services, you agree to all the terms and conditions stated in this Privacy Policy.

Background

Watch Our Own offers Services designed to enable you and the members of the group you create or accept membership in ("Group(s)"), to assist in the support of someone you care about. All the information in a Group is managed by you or the administrator of your Group, who decides who and when to share information with and when to remove access.

A Group may also share information during a live event and via remote access to first responder dispatch. For example, a member may need to look up medical information to provide to a first responder. The individual in charge may initiate an "Emergency Code" to allow first responder dispatch to access it via app.watchourown.com/first-response.

How We Protect Your Information

We take reasonable measures to protect your personally identifiable information ("Personal Information") to prevent unauthorized use, access, and disclosure. Your name and e-mail address, along with other identifying information described in Section III, constitute your Personal Information.

Please be aware that security measures are not impenetrable, and we cannot guarantee against misuse.

What Information We Collect

Contact Information

If you contact us through the Services, we collect your name, telephone number, home address, and email address ("Contact Information") in order to communicate with you, including for billing and Group activity notifications. We may also collect additional Personal Information you voluntarily submit for other purposes, including to open an account.

Services Visitor Data

Directly or through third-party data analytics, we may collect visitor information including your IP address and server log data (prior page address, browser type and settings, date and time, language preferences). We may also gather device information such as type, operating system, settings, application IDs, location, unique device identifiers, and crash data.

In connection with the Services, you may publish, display, or transmit the following information:

  • Health and Medical Information (conditions, symptoms, prescriptions, vitals such as heart rate)

How We Use Your Information

  • To operate Groups as described in Section I.
  • To operate, manage, and improve our Services, and for marketing and administrative purposes.
  • To send newsletters and marketing communications (you may opt out at any time).
  • To send notifications, updates, and changes about our Services, and to provide customer support.
  • To improve our programs and Services using your information, including voluntarily shared data.
  • To comply with legal or regulatory requirements, respond to court orders, enforce our rights, prevent fraud, and protect security and safety.
  • To analyze usage, administer Services, and gather aggregate demographic information using IP address and location data.
  • With your consent, in other ways as agreed.

Information-Specific Uses

  • Health and Medical Information — Used to manage health data within Groups.
  • Photos — Yours and your Group's to manage and share. You are responsible for keeping care recipient photos current.
  • Documents — Currently used to optionally store living will and do-not-resuscitate documents.
  • Videos — Used for live event streaming within a Group. Videos are not currently saved.
  • Event Information and Historical Data — Previous events (excluding video) are accessible within Groups.
  • Prescription Schedule — Used to set reminders with three levels of escalation notification.
  • Location Information — Used to enable Group members to locate care recipients and caregivers, and to map nearby emergency services.
  • Location Schedule — Used to define geo-fenced locations and times for care recipients. Note: weak mobile signal may cause false alerts.
  • Guardian Coverage Schedule — Used to organize caregiver coverage schedules by date and time.
  • Chat Data — Enables in-event chat with Group members; data may persist in historical events.

How We Share Your Information

We do not knowingly sell, trade, or otherwise share your Personal Information with third parties without your consent, except:

  • As described for Groups in Section I;
  • As required by law;
  • When reasonably necessary to prevent illegal activities, suspected fraud, or to protect safety;
  • In connection with a merger, acquisition, or sale of assets; and/or
  • As otherwise disclosed in this Privacy Policy.

We may share location information with Google Maps (Google, LLC) for the purpose of providing maps within the Services.

Cookies and Other Technologies

What are cookies?

A cookie is a small file placed on your computer's hard disk or on a server. Cookies do not retrieve information stored on your hard drive and do not damage your computer or files. For users of our Services, we may link cookie information to your email address to maintain and recall your preferences.

Why we use cookies

We may use cookies and similar tracking technologies to improve or administer the Services, analyze trends, track user movements, support security features, and gather demographic information about our user base.

Opt-in / Opt-out of Communications

By using our Services, you expressly allow us to contact you and use your information as set forth in this Privacy Policy. You may opt-out of receiving marketing emails at any time by clicking the "unsubscribe" button in any marketing email we send.

Your Choice to Access, Edit, or Delete Information

We strive to provide you with as many choices and as much control as possible over your Personal Information. You have the right to access and change your Personal Information. Please contact us (see bottom of this page) to find out how.

We will, upon receiving your request, make reasonable efforts to correct, delete, and/or block your Personal Information from further use to the extent it remains in our possession, except where not permitted by law.

Minors

Our Services are not directed at nor intended for individuals under 13. If you are under the age of 13, please do not attempt to register or send any information about yourself to us. If you learn that a child under 13 has provided us with Personal Information, please contact us. We will promptly delete any such data upon becoming aware of it.

Business Transactions

In the event of a business transition — including a merger, acquisition, partnership, business reorganization, debt financing, sale of assets, insolvency, bankruptcy, or receivership — we may use information collected in accordance with this Privacy Policy as part of such transition. In such instances, your information may be part of the assets transferred.

You may have implemented a "do-not-track" signal through your browser. We currently do not respond to do-not-track signals from your web browser.

Data Retention and Destruction

We will retain Personal Information for as long as necessary to accomplish the purposes described in this Privacy Policy. You can request deletion of your information by contacting us at the address provided below. Upon deletion, we will destroy your Personal Information using reasonable data destruction practices.

We may, however, retain certain information to comply with legal or contract obligations or to facilitate law enforcement requests.

We may revise this Privacy Policy from time to time. If we decide to change our Privacy Policy, we will post the revised statement here. If changes are significant and materially affect your rights, we may provide a more prominent notice on the Services or via email.

  • To provide requested information, products, or services.
  • To provide customers with information regarding you and customer products or services.
  • To provide email alerts, event registrations, and notices about our products, services, or events.
  • To carry out obligations and enforce rights arising from contracts, including billing and collections.
  • To improve our Services and present their contents to you.

Sharing Personal Information (CCPA)

We may disclose your personal information to third parties for a business purpose under a contract requiring confidentiality. In the preceding 12 months, we disclosed the following category of personal information for a business purpose:

  • Location information to Google, LLC for Google Maps.

We also disclose personal information to third parties you or your agents authorize in connection with Groups. In the preceding twelve (12) months, we have not sold any personal information.

Your Rights and Choices (CCPA)

California residents have the right to request disclosure of the categories and specific pieces of personal information we have collected, the sources, our business purposes, and the third parties we share with. You also have the right to request deletion of your personal information, subject to certain exceptions.

To exercise these rights, submit a verifiable consumer request by contacting us at support@watchourown.com or by calling (615) 698-1393 / Toll Free: (615) 698-1395. You may only make a verifiable consumer request for access or data portability twice within a 12-month period.

We endeavor to respond to verifiable consumer requests within 45 days. If we require more time (up to 90 days), we will inform you in writing.

Non-Discrimination (CCPA)

We will not discriminate against you for exercising any of your CCPA rights. We will not deny you goods or services, charge different prices, or provide a different level or quality of goods or services based on your exercise of these rights.
