Bmw Automatic Headlights Always On

Hi When I turn the lights to auto (A position) they are always on. This is not down to current light conditions, they are on, permanently just the same as turning the switch the other way to the 'on' position. Is there an adjustment for the sensitivity? Can auto lights be turned on/off by.

I leave my headlights on Auto setting and my headlights stay on all the time. In addition it seems that my headlights and my high beams aren't hookedup right. When I push for high beam on one side the headlight stays on and the higbeam also turns on.

On the right side just the highbeam turns on. Which way is it suppose to be? I have a 02 540i. 1.
