Sommelier Snap (the "App") is operated by SniffSafari Labs, LLC ("we," "us," or "our"). By accessing or using the App, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
1. Age Verification and Acceptance of Terms
By accessing or using Sommelier Snap, you confirm that:
- You are at least 21 years of age, or the legal drinking age in your jurisdiction, whichever is higher.
- You understand that providing false age information is illegal and may result in legal consequences.
- You accept full responsibility for ensuring your compliance with all local laws regarding alcohol.
- You will not allow minors to access this application through your device.
- You agree to be bound by these Terms.
Misrepresentation of age is a violation of these Terms and applicable law. We reserve the right to terminate access immediately and without notice if we suspect age misrepresentation.
Creating an account requires you to re-attest to being of legal drinking age. We record this attestation on our servers — including the timestamp, the version of these Terms you accepted, the jurisdiction and age threshold shown to you, and the IP address of your device — as legal evidence of your confirmation. See our Privacy Policy (Section 14) for full details on what is recorded and how to delete it.
2. Beta / Pre-Release Software
Sommelier Snap is currently offered as a free, pre-release beta for evaluation and feedback purposes only. You acknowledge that:
- The App is under active development and may contain bugs, errors, or inaccuracies.
- The App may not operate reliably or without interruption, and we make no guarantee of availability, uptime, or service level.
- We may, at any time and without prior notice or liability to you: modify, suspend, or discontinue the App or any feature; limit or terminate your access; and add, change, reset, or permanently delete data associated with the beta, including your account and saved content.
- You should not rely on the App to store the only copy of any information important to you.
Your use of the beta is entirely at your own risk.
Participation in the beta program does not create any ownership interest, partnership, joint venture, employment relationship, agency relationship, co-inventorship claim, or right to compensation relating to Sommelier Snap, SniffSafari Labs, LLC, or any associated intellectual property, products, services, features, or business opportunities.
Participation in the beta is voluntary and provided solely for evaluation and feedback purposes.
Participation in the beta does not guarantee future access to the App, continued availability of any feature, eligibility for any future commercial release, grandfathered pricing, free access, discounts, or any other benefit. We may change pricing, features, functionality, access rights, or eligibility requirements at any time in our sole discretion.
3. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant or guarantee:
- Accuracy of wine recommendations
- Suitability for dietary restrictions or allergies
- Completeness of OCR-extracted information
- Compatibility with personal taste preferences
- Availability of recommended wines
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
4. AI-Generated Recommendations
Wine recommendations, tasting notes, pairings, and related content in the App are generated by automated artificial-intelligence systems. AI outputs may be inaccurate, incomplete, outdated, or otherwise wrong, and are provided for general informational purposes only — they are not professional, sommelier, medical, dietary, or purchasing advice.
You are solely responsible for independently verifying any recommendation — including a wine's ingredients, allergens, availability, price, and suitability for you — before acting on it. Do not rely on the App's output as the sole basis for any consumption or purchasing decision.
5. Limitation of Liability
To the maximum extent permitted by applicable law:
- Excluded Damages. We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits or revenue, loss of data or use, or business interruption, arising out of or related to your use of (or inability to use) the App, even if we have been advised of the possibility of such damages.
- Liability Cap. Our total cumulative liability arising out of or related to the App will not exceed the greater of (i) the total amount you paid us, if any, for the App in the twelve months preceding the claim, or (ii) one hundred U.S. dollars ($100).
- Carve-Outs. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, or any liability that applicable law does not permit us to disclaim. Some jurisdictions do not allow the limitation or exclusion of certain damages, so portions of this section may not apply to you.
- Recommendation & Third-Party Disclaimer. Wine recommendations are suggestions only; we are not liable for their accuracy or suitability, for wine availability or pricing, or for decisions you make based on them. We are not responsible for third-party services, including wine vendors, restaurants, or payment processors.
6. Your License to Use the App; Acceptable Use
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial use during the beta.
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code, models, or underlying algorithms of the App;
- Scrape, harvest, or use any automated means to access the App or its OCR/AI endpoints;
- Resell, sublicense, rent, or commercially exploit the App or its output;
- Interfere with, disrupt, or overload our infrastructure; or
- Use the App to violate any law, including alcohol-related laws in your jurisdiction.
7. User Responsibilities
You acknowledge that you will:
- Verify all recommendations independently
- Check for personal allergies and dietary restrictions
- Use recommendations as suggestions, not definitive guidance
- Confirm the legal drinking age in your jurisdiction
- Drink responsibly and never drink and drive
- Use the App in compliance with all local laws and regulations
- Not share or provide access to minors
8. Health and Safety Disclaimers
- The App does not provide medical or dietary advice. Consult healthcare professionals for medical concerns.
- Responsible alcohol consumption is required; age verification is mandatory before app access.
Sommelier Snap does not screen for allergens or dietary restrictions.
Users with allergies or dietary restrictions must independently verify all wine ingredients. Always check wine labels, contact producers, and consult healthcare professionals before consumption. We disclaim all liability for allergic reactions or dietary complications from recommended wines. See our separate Allergen & Dietary Notice.
9. Intellectual Property
- All content, features, and functionality of the App are owned by SniffSafari Labs, LLC and are protected by copyright, trademark, trade secret, and other intellectual-property laws.
- The App's recommendation logic, prompt designs, machine-learning integrations, and OCR processing are proprietary and include protected trade secrets.
- Any attempt to reverse engineer, copy, or reproduce the App's core technologies is strictly prohibited and may result in termination and legal action.
10. User Content and Feedback
- User Content. By submitting wine ratings, reviews, or other content, you grant SniffSafari Labs, LLC a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content. You retain ownership of your original content. You represent that you have the right to submit any content and that it does not infringe third-party rights. We may remove any content that violates these Terms.
- Feedback. If you send us suggestions, ideas, bug reports, feature requests, or other feedback ("Feedback"), you grant SniffSafari Labs, LLC a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable and transferable license to use, reproduce, modify, distribute, and otherwise exploit that Feedback for any purpose, without any obligation, attribution, or compensation to you. You agree that Feedback is provided voluntarily, that we may already be developing similar ideas independently, and that nothing in your Feedback creates any ownership, co-inventorship, or other intellectual-property interest in the App on your behalf.
11. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
12. Modifications and Re-Acceptance
We may modify these Terms at any time. When we make a material change, we will require you to review and accept the updated Terms before continuing to use the App, and we will record your acceptance of the new version. For non-material changes (such as typographical or formatting corrections), continued use of the App after the change constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-law provisions.
14. Indemnification
You agree to indemnify, defend, and hold harmless SniffSafari Labs, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: your use or misuse of the App; your violation of these Terms; your violation of any third-party rights; any harm resulting from your wine-consumption decisions; or false age verification or misrepresentation.
15. Dispute Resolution
- Dispute Resolution: All disputes will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Unless otherwise required by applicable law, the arbitration shall be conducted in the Commonwealth of Massachusetts, USA. The Consumer Arbitration Rules govern the allocation of arbitration fees and limit the costs payable by consumers.
- Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in a class action.
- Small Claims Exception: Either party may pursue a qualifying claim in small claims court.
- The prevailing party may be entitled to recover reasonable legal fees to the extent permitted by law.
16. Miscellaneous
- Severability: If any provision is found invalid, the remaining provisions remain in effect.
- Entire Agreement: These Terms, together with the Privacy Policy and Allergen Notice, constitute the entire agreement between you and us.
- No Waiver: Failure to enforce any provision is not a waiver.
- Assignment: We may assign these Terms; you may not without our written consent.
- Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control.
