Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MedArchive mobile application and related services (collectively, the "Service") provided by MedArchive ("we", "our", or "us"). Please read these Terms carefully before using the Service.

By creating an account, accessing, or using MedArchive, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

1. Description of the Service

MedArchive is a personal health record organizer that allows you to import, store, organize, search, and manage medical exams and related documents. The Service may include features such as profile management, reminders, subscriptions, cloud sync, and document processing.

MedArchive is an organizational tool. It does not provide medical advice, diagnosis, or treatment, and it is not a substitute for professional healthcare.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using MedArchive, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

If you use the Service on behalf of another person (for example, a family member), you represent that you have the authority to do so and to accept these Terms on their behalf where applicable.

Some features may require a paid subscription or in-app purchase. Payments are processed by Apple App Store or Google Play according to their respective terms and policies. We do not store your full payment card information.

Subscriptions renew automatically unless canceled through your app store account settings before the renewal date. Refunds are handled according to the policies of the platform where you made the purchase.

We may change subscription prices or features with reasonable notice where required by applicable law or platform rules.

MedArchive helps you organize health-related documents for personal reference only. We do not verify the accuracy, completeness, or clinical relevance of Your Content or any information extracted from it.

Always seek the advice of a qualified healthcare professional with questions about a medical condition, treatment, or test results. Never disregard professional medical advice or delay seeking it because of something you accessed through MedArchive.

8. Intellectual Property

The Service, including its software, design, logos, text, and graphics (excluding Your Content), is owned by MedArchive or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

We strive to keep MedArchive available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, to the extent permitted by law.

We may release updates that are required for continued use of the Service. You are responsible for keeping the app updated to a supported version when reasonably possible.

You may stop using the Service at any time and may delete your account through the app or by contacting us.

We may suspend or terminate your access if you violate these Terms, if required by law, or if we reasonably believe your use poses a risk to the Service, other users, or third parties.

Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination will remain in effect.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE, UNINTERRUPTED, ACCURATE, OR FREE OF ERRORS, OR THAT YOUR CONTENT WILL NEVER BE LOST. YOU USE THE SERVICE AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDARCHIVE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $50, EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.

You agree to indemnify and hold harmless MedArchive and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

14. Governing Law and Disputes

These Terms are governed by the laws applicable in your country of residence, unless mandatory local law requires otherwise. Any dispute arising from these Terms or the Service should first be addressed by contacting us. Where permitted by law, courts with competent jurisdiction in your place of residence may hear such disputes.

15. Changes to These Terms

We may update these Terms from time to time. We will post the revised version with an updated "Last updated" date. Material changes may be communicated through the app or by other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
