 Kiir delegates powers to state governors 

Based on the transitional constitution of the Republic of South Sudan, state governors shall appoint state officials including deputy governors.

JUBA – South Sudan’s president, Salva Kiir Mayardit has said in a Republican order issued on Tuesday that he was delegating a number of powers to all the ten state governors including, but not limited to swearing into office officials who were recently appointed by the president.

Based on the transitional constitution of the Republic of South Sudan, state governors shall appoint state officials including deputy governors. However, President Salva Kiir recently appointed the state officials bypassing the constitution with information minister Michael Makuei citing absence of ‘valid’ constitution at the state levels.

“Each Governor is hereby delegated the power to swear into Office the appointed State Government officials in accordance with the provisions of the respective State constitution and local Government Act, 2009, save by the power to appoint or remove, which the Revitalized Agreement on the Resolution of the Conflict in the Republic of South Sudan (R-ARCSS , 2018, vests in the Presidency ( in collegial manner), the parties to the Agreement and RJMEC respectively,” the decree seen by Sudans Post read in part.

“All the States Governors, State and Local Government officials shall, pending amendment of the State Constitutions and the local Government Act, 2009 , exercise their respective legal mandates in conformity with the terms of the Revitalized Agreement and in a collegial manner to avoid any disagreements,” it added.
