Arms Fraud: Court to hear ex-army chief’s suit against EFCC June 8

On Wednesday, the Abuja Division of the Federal High Court fixed June 8 for a definite hearing of the suit filed by a former Chief of Army Staff, Lt.-Gen. Kenneth Minimah against the Economic and Financial Crimes Commission (EFCC).

Other plaintiffs in the matter are a one-time Chief of Accounts and Budget of the Nigerian Army, Maj.- Gen. A. O. Adetayo, and the former Director, Finance and Accounts of the Nigerian Army, Brig. Gen. R. I. Odi.

Mr Minimah and his co-plaintiffs are challenging the validity of a criminal charge instituted against them by the EFCC at the FCT High Court.

EFCC had filed a criminal charge against the ex-army chief and others over the alleged diversion of over N13 billion meant for arms procurement.

When the matter was called, the plaintiffs’ counsel, Efut Okoi, told the court that his team had regularised and served their processes on all the defendants.

Counsel to the defendants, Habiba Chime, and Mohammed Buba, both agreed that they had been served.

Mr Okoi also told the court that he intended to call about three witnesses to give evidence in the matter.

Justice Inyang Ekwo reminded Mr Okoi that if at any point he appeared not to be ready to move on with the matter, he would strike it out.

The defendants named in the suit are the Attorney General of the Federation, the Minister of Justice, and the EFCC.

Mr Ekwo adjourned the matter until June 8, 9 and 10 for hearing.
