Court grants mother custody of three children

The Centre-Igboro Area Court, Ilorin, has awarded custody of three children to their mother, Bashirat Omolara, while their father, Abdulhameed Alabi, takes responsibility for the children’s welfare.

While delivering judgment, the presiding judge, AbdulKadir Ahmed, said, “Consequential to dissolution of marriage on December 21, 2023, when the wife filed for divorce and agreed by the two parties.

“The estranged husband had insisted to have custody of their three children with reasons.”

The judge, however, said that the claimant could not provide witnesses to his proof of why the defendant could not have custody of the children.

Mr Ahmed said the reasons the claimant gave were not strong enough and had no proof according to Islamic law.

He, therefore, granted custody of the three children to the mother and ordered the father to provide for their feeding, school fees and welfare to the best of his ability.

The court also ruled that the father could have unrestricted access to his children and be well-informed about their personal lives.
