Court restrains Gov Dapo Abiodun from demolishing Gbenga Daniel’s property

The judge adjourned the case until August 19 for the hearing of an interlocutory injunction.

The Ogun State High Court, Sagamu Division, has restrained the Governor Dapo Abiodun government from demolishing properties belonging to Ogun East senator, Gbenga Daniel, located in Sagamu GRA (now Awolowo Avenue).

This was disclosed in three separate interim injunctions, HCS/371/2025, HCS/372/2025, and HCS/373/2025, dated August 12, and granted by presiding judge, Justice O.S. Oloyede.

The judge issued the order following ex parte applications filed by Mr Daniel’s counsel, A.M. Kotoye, against the governor, the attorney-general, and the Commissioner for Justice, Oluwasina Ogungbade; the State Planning and Development Permit Authority; as well as the Commissioner for Physical Planning and Urban Development, Olatunji Odunlami.

Officials of the state planning and development permit authority had issued notices of demolition and sealing on Friday, which they later removed. They urged Mr Daniel to send someone to the issuing office with his permits and documents for verification within a stipulated period.

Mr Daniel and his wife, Olufunke, in the first suit, asked the court to issue the order against the proposed demolition of Asoludero Court, a 1,659-hectare estate, after the state government allegedly served them a quit notice dated August 8, 2025.

After review of the affidavit, the judge ruled, “The defendants, their servants, agents, or privies are hereby restrained from demolishing, trespassing on, or disturbing the claimants’ quiet possession of the property pending the determination of the motion on notice.”

The judge adjourned the case until August 19 for the hearing of an interlocutory injunction.

Mr Daniel, who listed his Conference Hotel Limited, Blue Chapel Limited and his wife as applicants in the second and third suits respectively, claiming that the hotel’s Certificate of Occupancy, dated April 8, remains valid and subsisting, also through his counsel, secured orders by the judge restraining the state government from demolishing or “tampering with the applicants’ possession and enjoyment of the property until the next hearing”.

Despite the restraining order, Mr Daniel took extra steps to safeguard his properties. On Monday night, soldiers were seen on guard at the high-end properties, while youths, allegedly locals, kept vigil around the premises since Mr Abiodun announced the demolition notice.

“The soldiers are around from 8:00 a.m. till in the evening, while members of the Oodua Peoples Congress will take over through the night,” a spokesperson for Mr Gbenga, Steve Oliyide, said.

The governor and the senator, from the same senatorial zone, are at loggerheads over the Red Chamber slot. Messrs Abiodun and Daniel are keenly interested in contesting the senatorial poll in 2027.
