Sanusi Vs Bayero: CJN Ariwoola summons Kano chief judge, federal judge over conflicting injunctions

Following their conflicting interim orders concerning the Emir of Kano imbroglio, the Chief Justice of Nigeria, Kayode Ariwoola, has summoned the chief judge of the Kano Division of the Federal High Court and the Chief Judge of the Kano State High Court.

Justice S.A. Amobeda of the Kano Division of the Federal High Court had issued an interim injunction barring the reinstatement of Emir Muhammadu Sanusi II and nullifying the dethronement of Aminu Ado Bayero as the 15th Kano Emir of Kano.

“An order of interim injunction restraining the respondents from inviting, arresting, detaining, threatening, intimidating, harassing the Applicant, or infringing on his rights is hereby granted. This order ensures that Emir Aminu Bayero enjoys all rights and privileges accrued to him by virtue of his position,” said the judge.

The judge’s ruling followed Justice Amina Adamu Aliyu of the Kano State High Court’s injunction affirming Mr Sanusi’s reinstatement.

Mr Aliyu also granted an order of interim injunction “restraining the Respondents from harassing or intimidating the Applicants or confiscating any symbols of the Emir’s authority,” adding that “the respondents are ordered to maintain the status quo pending the hearing and determination of the motion on notice.”

The conflicting orders had already thrown Kano into chaos, with supporters of Messrs Sanusi and Bayero staging protests over who is lawfully recognised as emir.

Further hearing on the case at the Kano High Court was fixed for June 13, while the Federal High Court adjourned the case on the same matter until June 4, 2024.
